NIP in 2010, Summons in 2012?

Im after some advice really.

I was caught on the Bristol ring road on 19th January 2010 by a mobile camera van unit doing 94mph in a 50 (one of only a few 50mph sections on the road ). I got a bit excited e.t.c

I had a NIP through the post, said it was me who commited the offense, sent it off, 4 months later...heard nothing, moved house, changed DVLA details e.t.c Lived at new house for 2 years... heard nothing, then yesterday had a letter through the door saying there was a warrant out for my arrest for a motoring offense and that i must go to a police station to sort this out.

Naturally i did this and they got me a court date next month.

What im asking is, does this delay help my chances of a reduced penalty in any way? Are there any rules to how long they can leave it? Im guessing no to both...

Also i had 3points / £60 fine in 2008 and thats it. I presume i am looking at 6 points, a ban and a fine, any ideas what ballpark region?

94 in a 50 is a little more than a bit excited.

You're out of the sentencing guidelines, so expect to have the book thrown at you. Have you purely been charged with the speeding offence or have they not tacked dangerous driving on there as well?

I'd be going to a solicitor.
 
I was caught doing a similar speed (not quite as fast) in a 50 early last year.

NIP came in April and I was in court in September so quite a distance between them.

I was facing either 6 points and a large fine or no points, a ban and a smaller fine. I got a 6 week ban and £200 fine, £50 costs.

I was ******* bricks but it wasn't as bad as I was expecting. I dressed well and showed remorse which I think helps in getting you a slightly more lenient punishment. The amount of scrotes in tracksuit bottoms though, I guess they're pleased when somebody makes the effort, hah.

Thanks for the reply, yes i was stupid im not here for sympathy, i did wrong and i will pay for it, thankfully im now a bit older and wiser.

The charges are for speeding offense only, not dangerous driving. I going to get on the phone to a solicitor in the morning!
 
Not giving you a kick for it; I was caught doing something very silly too as a lot of people on here have seen (running a red light next to a police car.... with the roof down... at 16mph).

Hope it works out okay for you.
 
That ring road is stupid, there seems to be no logic as to where the 50's and NSL's are, one stretch will be one, and then turn into the other after a roundabout despite being similar, and in reality you could easily, and I have when late for a college exam back in the day, average 100 the whole way down from the m32 past Longwell Green without any drama.

Do you still have copies of the correspondence with the DVLA?

Because chances are they will try to spin it that you've been trying to avoid them because they have been trying really really hard honestly to find you for the past two years.

They only have 6 months from the NIP to get a court date..
You must request to see the date that they put the information in front of the magistrate, if its 6 months after the NIP they have no case.

However, since he moved house within that time period it is quite probable that the summons was sent to his old address, probably within the applicable time frames.

Given that it was 4 months later that he moved house, then they had his details for 2 years after that, I would suspect not.

My brother had a similar situation to this, almost an exact same situation to this, pulled for speeding issued a ticket and because he kicked up a fuss that he wasnt speeding he got a subsequent ticket for not having a seat belt on. He sent the NIP back denying both charges then moved to a new flat 2 weeks later.
They indeed sent a summons to his old address, but then when he obviously didnt get it and failed to attend court on the date in question, they sent another one to his new address this time with an added no insurance charge on there as well (as he wasnt there to produce evidence of having it), all off their own back.

He successfully defended the no insurance, as he was indeed insured, and the no seat belt charge, but didnt get off the speeding.

If matey here had been given a court date within the time limit it wouldnt of taken them two years to issue a warrent for his arrest.


But yes, he should speak to a solicitor as well.

Definitely get legal advice, quickly.

You are almost certainly getting banned unless you have epic mitigating circumstances.

I used Motor Lawyers when I had a motoring conviction issue. I actually did pay to get Nick Freeman to look at the documents but in his words I'd been 'too honest at the scene' for him to be able to do anything.

Before I had spoken to Motor Lawyers I was looking at proper anal raping. After using them we went full trial and got found not guilty. Amazing what knowledge of the law can do for you....

I've never laughed so hard at an internet picture in my life. If there was a way to get caught breaking the law, it's got to be the way you did it :)
 
As above get legal advise asap. My brother had a speeding ticket through the post and then was moved in the army so never had any follow ups until 6 months ago, he had originally sent the ticket back admitting the charge.

When he was summoned to court the judge made it very clear that trying to avoid a court summons by failing to notify them of a change of address is a very serious offense. Luckily he had his Army boss with him and he waffled on about the posting being of operational requirement and was at very short notice blah blah....

It would be worth getting some good legal advise as from what I gathered in court it's up to you to notify them of a change of address during a summons...?
 
I *may* have been a bit slack about changing DVLA details, i probably left it about 3 months after moving house, more i think about it they have probably been sending requests to my old address.

Although i was registered with JSA and Got full employment as soon as i moved so im sure i should have popped up on some national database of "whereabouts" ?

I have fired off a few enquiries to some motoring solicitors, will be looking for representation in court, although i fully expect a ban.

Why would they tack dangerous driving on there? Literally no camera caught speeding offence will have dangerous driving, only those pulled by cars, and even then, other cars would have to be involved, or the road would have to be super busy, or the driver swinging lanes like a complete lesbian. Camera can't record such details (unless sited cameras such as by a school), hence no DD penalties :)
 
i got caught recently doing 104mph on motorway. Had a favourable report from police, clear road, perfect weather, pulled over straight away etc and pleaded guilty. Copped 6 points and a £700 fine reduced to £500 for pleading early. £300 legal bill topped it off nicely, lesson learned...
 
Only in relation to any legal costs arising from insurance claims.
That sucks. I pay extra for legal insurance and I had a lawyer go to court on my behalf when I got caught.
I just had to pay a fine and costs (on top of my ban).
