Nokia E71 Volume key problem

Hi , I recently got a Nokia E71 as my free upgrade from orange. I've come across a problem though and I'm wondering if anyone has experienced the same or know of a fix ?

When using various games I find that the volume side keys do not work to turn down the volume. With some games there are in-menu options to decrease or turn off the sound but for the games without I am stuck with obnoxiously loud volume and have no way of turning it down. Am I missing something obvious or is this a common problem ?
 
My volume down key stopped working on my N95 when i had it. Took it to carphonewarehouse to be repaired and got it back the next day with no hassle.

Its not a case of it not working , I've had it for less than a week and the side volume keys work in calls , on speakerphone and in the internet browser. It's literally just in-game volume I cannot control.
 
Then its down to the app or games and not the phone...not much you can do about it unless u get in touch with the developer and ask them to rectify it.
 
Seems like a big pile of crap to me , I never had problems with my old 6500 java games , and functions as fundamental as basic volume control being overlooked is shocking. I'm pretty sure it isnt the apps fault either as I have the same apps installed on my old phone working fine , the only difference is the screen resolution.
I have tried at least 15 different apps and games and none of their volumes can be controlled by the phone. Think I may take advantage of the returns policy and get something different.
