Non Fault Crash - First time in this situation

Good morning,

Was involved in a car accident this morning where pulling up to a T-Junction somebody turned into the road i was driving on but cut in on my side of the road (driving a fair pace). They have accepted that it is there fault and have done so through there insurance also.

I have started the claim process with their insurance as he accepted fault for the incident. My issue is that my car is unfortunately not worth a great amount and if it was through my own insurance at my fault it would almost certainly be a write off (front bumper/headlight/front quarter bent in so drivers door only partially opens)

Is there any precedent for getting the car repaired even if it exceeds the worth of the car? Or for like4like cost. I got the car particularly cheap and lucked out on it been a reliable workhorse and for money its worth will be a lottery if i get similar again or not! Very fustrating
 
You can't make them repair it, if they deem it not worth the costs and write it off, then you'd have to buy it back and repair yourself, but that's a lot of effort and can cost a lot.

Suspected that would be the case, just annoying as will be left out of pocket through no fault of my own. If our other car wouldn't be an issue as damage wouldnt have written the car off. Only happened this morning but wouldnt fancy repairing myself as a fairly big hit and wouldnt be sure what other damage was done beyond surface damage :( Will just have to cross my fingers for the valuation
 
I would go see a doctor aswell and have a check up if it was a fairly good whack. Some pains like neck and back pain can take a day or 2 to show up and end up taking you out of work for a while.

In no way way hinting to make an injury claim if you ain't injured but sometimes insurers will ring to settle an lowball injury claim straight away. Stall it if they do and mention you are going to see a doctor.

My cousin ended having to take 2month off work after he got t-boned and thought he was ok for the first few days.
 
True on the injury thing, whiplash isnt an instant thing it takes usually a few days to come out. Like when you have a major wipeout in skiing, its the next day or so you go ouch cant move my neck properly :)

People who go "ooo my neck" the second after the accident are almost certainly faking, they may have whiplash but its not going to kick in that quickly.
 
Repair costs through " authorised agents " can be really excessive as a lot of parts are quoted from manufacture when they can be bough for a fraction of the cost from 3rd parties or 2nd hand parts.

if its a cat C/D write off you can buy it back at a fraction of the cost and then self repair or sell for parts to make a profit.

As mentioned by Rybo some insurance companies are offering basically pay off cash. offering like £1000-2000 to sign a form stating you will no pursue any additional damages claims against them for personal injury. As sometime injuries get progressively worse meaning by time goes to court they have to pay out 5-6 times more

Havent gone to doctors yet but will see how i feel tomorrow, i have indicated to the insurance that i didnt feel any neck pain however i can feel my chest as if i had been punched (will have been the seatbelt probably). Considering someone has mentioned skiing accident i am off skiing mid way through march so dont think claiming whiplash then going skiing is viable!

Thank you for the guide, i had an accident in my Panda a couple of years ago and managed to get write off, buy back for very little and sell as spares and repairs to get a bit of money. Different as this car is a 2003 Honda Civic 1.6 Sport with 123k, therefore not worth very much at all. However has been reliable and showing no sign of mechanical fault which is why its frustrating i will have to go through the lottery of buying a "shed" type car as a replacement and hope its as reliable...

That was my thinking, I'm sure I saw somewhere that it was illegal for the 3rd party insurer to write the vehicle off unless it would pose a future safety risk, if so I doubt that many would know this and unknowingly accept that when dealing with another insurer. May be completely wrong, but otherwise it means you could potentially loose out on something that ultimately isn't your fault.

Thanks for digging that up! Went directly to their insurer (Admiral) so my insurance company not had anything to do with it so far. Have already got the hire car if im honest as needed it for work as my car cannot be driven so needed that to be sorted out. Have thought about the repair at home route however due to the force of the impact I would think that there is further damage then just the front wing, bumper and headlight. Will need to take another look at it when i get home.
