Cut it out.

They have the responsibility to provide you a refund if you ask for it. "ETA" is not an agreed time of arrival, it's an estimate. You agreed to a pre-order, which means they don't have it and aren't liable to the 30 day limit.
You can ask for a refund or you can wait. Those are your two options. No attempts to spin some kind of legal case in a forum will get it to you faster.
I'm frustrated at the poor comms, not even living up to their own promises on updates, but this "I want a card they don't have now or LEGAL" is just dull Karening. Cut it.

They have much greater profit margins on pre-built systems. It wouldn't surprise me if those orders are getting preferential treatment.

I don't justify them, but they are willing to refund if you don't want to queue, they don't have cards, and moaning on the forum won't make them have a card to send you. I think no one should pre order something that you don't know when you going to receive, it's your choice to still be in the queue, I dropped weeks ago.
