OCZ Agility 3 problems - Firmware?

I am considering getting a Agility 3 120GB for os and a few games but am not sure after all the reports of cold boot problems on OcUK and OCZ forums.

Is it likely to be something a firmware update would sort out or could there be other factors like incompatibility?
