I was traveling down a back road the other night and I came round a bend and there was a dead deer in the middle of my lane. I had no time to swerve or slow down in time so I had no choice but to kurb as much speed as possible and go over it with it going between my front wheels. Anyway it struck the front splitter on my car and now it's slightly out of shape. Is there any claim that can be made of the council for not cleaning it up? Judging by the mess of the poor animal it had been hit pretty hard and I'm sure the driver that hit would have stopped at least and possibly called the police etc.

I'm probably clutching at straws here but who knows.
 
Worth a try. I only noticed it when the car was up on a ramp last night when I changed the oil. Only slight imperfection but I know it's there and it'll need a new splitter to sort it. Won't be cheap!
 
Would probably get a better response in Motors, especially at this time of night. God only knows what kind of creatures lurk in the midst of GD in these hours.
 
Don't you get in trouble if you smack one? i know you do around my area

You could possibly get done for dangerous driving, or something similar, i dont think you can get done for hitting it to be honest as you cant really avoid one.. if you purposely hit it and there are witnesses then obviously there will be an issue brought to your front door.

But as for insurance, councils etc... i dont think they will do anything, its not their faults and they will claim they knew nothing about it.

Its always worth a shot expecially as you have lost already, you cant really loose no more than you have so, go for it bud, and let us know so i know for future referance :P

Does it look fresh? Possible venison? I have only ever read about it in Motors but people say if you hit an animal (edible), you cannot take it but only leave it for the next person. Is that true or a myth? Sorry, I am no help on the claim.

You should have stopped and dumped it in the back of your car. Venison for the next week or so, mmmmm! :D

EDIT: Slightly too slow, from what I understand DB_SamX you are correct, anyone but the person who hit the animal can take it away. :)
 
i hope you at least took it home and left to hang for a while, venison is a good meat

but you wont be able to claim anything on the damage done, and be glad it was not serious damage
 
Suing the council will just result in them reporting you to the police for Driving Without Due Care and Attention - which you clearly were or you'd have been able to stop in time. Cut your losses now.

The (belated) good news is that I believe that you can take the body if someone else killed it - if you like venison.

errrr? how can you possibly know that he said he came round a bend, and someone else has clearly not seen it there too, we don't have x-ray vision.

Because you are supposed to be able to stop in the distance you can see to be clear?
 
I loved it when this came up in motors a while back. The number of people who said they would stick it in the back of the car and eat the thing... yeah right :p
 
Oh the memories of what happened to me.

Travelling down a country road at 50mph, Deer number one jumps over right, Avoid, Deer Number two jumps over.. Bang.

Broke the deer's leg and it was running around with one leg spinning like a helicopter blade. Called the police and they came within 5 minutes or so, They arranged a marksman to come down and shoot it.

I drove on my merry way.
 
My brother has just fallen off his bike (motor) due to Oil on the local road. We sued the council and got about £300. The police advised us to do this to claim the damage cost and some compensation. I do belive its against the law. You stand a great chance imo

I absolutely hate people who do this with passion. Whos to say that oil had only just been spilt?

Its an accident. Get over it.
