Ooops! Got a Small Problem and Need Your Help!

have you taken the new offer from o2?

you've got 3 options left IMO.

1) carry on arguing, probably get a result in the end but cost yourself a fortune in post and stress
2) contact o2 and explain and see if they can get any sense from them, DAP are their agent so they might be interested in an allogation of mis-selling if they sent you an open box then refused to return it
3) sell it on ebay and use the funds to buy yourself out of the contract, again o2 might make a settlement with you for this if you boot off enough, your original poor experience that drove you to DAP is a good place to start with this.
 
I havent taken out any new contract yet. But i seriously dont want this one ive applied for.

02's direct offer is so much better... but if they offered me this in the first place instead of being very rude then i wouldnt have even looked at DAP's contracts!

Defo want to cancel... oh and if i sell the phone on eBay id get about £200 for it :(

If you havnt taken up the 02 offer.
Then hang on a minute.
All you do, is ring up 02 customer services, and ask for the either the text or web bolt on.
ITs free to ALL tarrifs on 600 mins or over.
So to an easy way to get out of this predicament is to bite the bullet and keep the dial a phone N95 and just talk to 02 about tweaking the dial a phone deal.
02 wont care as you will still be a customer.

The only other upset is ive found out i cant keep my old 02 number... i currently have a simplicity 15 tariff aswell that i am yet to cancel.... but i want to keep that number or change my new one as its crap!

So which number do i phone out 02? Cancellations and explain my predicament?

keep the dial a phone phone.

Ring up O2 (202) explain what has happened.
Ask for your free bolt on (either texts or web) ask for you old number on this contract.

They will send you a new sim.

Problem sorted.
 
Just called them and i cant get a free bolt on for the new number as i went through DialaPhone. They also cant do me any sort of deal. So it looks like a have to keep it! Also.... as my old number is from an old 02 Contract and the DAP is a new 02 contract then i cant keep the same number!

So... Screwed!
 
So you havent ordered a new contract (from DAP) and then tried the sim card out therefore loosing any right to DSA?

I went to 02 to upgrade etc and was spoken to rudely and was fobbed off and told i couldnt have the phone or a deal as it was out of stock. So I took a new contract out with 02 through DAP getting the phone free next day. Got the phone etc.

However my current existing 02 contract which i have had since 06 is now a Simplicity. This was until i decided which tariff to go on. I can cancel my simplicity at any time (no tie in).

The thing is i got the new phone and tested the new sim card in my *old* phone. Made a quick 2 second call to see if it worked (it did) and then stuck it back in the box.

So 02 nor DAP can help me. So im stuck with the phone which i will sell!
 
right, so you have a slightly worse contract and a slightly worse number and a current contract/number you can cancel whenever.

I think perhaps you need to get this in perspective. You're hardly screwed.

Plus if you know someone who is good at arguing I'm sure you could get somewhere with o2 retentions by explaining the situation. Some sort of goodwill, threaten to make a fuss about it.

Otherwise its a situation similar to one where you've been to ikea, bought a sleeping device, built it and you don't like it but you must nevertheless use it.

no, sorry our shocking service and misinformation regarding your upgrade drove you into taking out a new contract mainly to get a free bolt on, here's a half price bolt on etc.
 
Just gonna sell the phone on eBay. What price would you say?

if you've signed an 18 month contract you will be liable for £558 of line rental. Just bear that in mind.. I expect if you can avoid scammers etc you'd be able to get about £300 for the handset, more if its unlocked.

So you'd be about £260 down. Looking at that another way thats £14 for each month of your contract for the sake of a free bolt on and your old number?

Or is your current dealing amazing?

I strongly advise some perspective here, I've been in mobiles for over a decade and I know they can be very emotive things but seriously...

If you current number is that good why not transfer it to payg that way you can have it back in say 12 months when the value of the phone gets closer to the outstanding contract value?
 
1. You can always keep your Simplicity number and port it onto your new contract - you just need to go through a PAYG SIM card from a different network. It's really easy.

2. It's utter madness to sell the N95 from Dialaphone. You're going to lose a lot more money that way compared to just paying a bit extra for the Internet Browsing bolt-on, which would be the only difference once you've transferred your old number over to the new contract.
