Parking Eye - Parking Charge

I thought this might be the best place to ask. Recently took a trip down to Newquay with the family and got a Parking Eye Parking Charge Notice to owner.

We bought a ticket but didnt keep hold of it (who does?) but now we got this letter through saying we owe £90 or £60 if we pay in 14 days.

My inlaws also got a letter stating the same and we both got the tickets together.

My wife sent an email of appeal confirming name and address. (Told her not to :rolleyes:)

Where do we stand?
 
If it's the one I know in Newquay they'll most likely send you a photograph showing that they can identify who was driving at the time.

Not sure what this really means legally though, just my 2p.
 
At the moment I am thinking bin it. Where would I stand as my father in law witnessed the transaction.

Can't see who is driving the car but my wife did sent an appeal email.
 
Is this a pay and display? Any photo would show the ticket surely....?

I would have filed it under B for Bin tbh but not sure if replying may have encouraged them / given some evidence should they drvisr to actually try for small claims court.

I'm pretty sure it'll be another nonsense ticket but head over to pepipoo and ask there
 
You can see the ticket in the photo but you wouldn't see any details. It just looks like a piece of paper.

I think I will risk it and not pay. Unless people convince otherwise

Only trouble you have is if she named who the driver was at the time. Thay have what they need to take it to court if they want to. The contract is with the driver but they can only send the invoice to the registered keeper and he/she is under no legal obligation to name the driver at the time.

Personally I have binned the ones we have had so far and not heard anything back.

Yeah well I paid for the ticket so they can take me to court if they like but they arent getting the money easily.

Im not quite sure i understand, you bought a ticket and they are persuing you for parking without a ticket or you outstayed the time on your ticket ?
Why would they think you didn't buy a ticket if you had one ?
 
parking eye generally requires you to input your full reg ? poundstretcher used this system in there car parks and there was a machine in store for you to enter the full reg ?
 
I love these threads. Isn't this where someone comes along to say unless it is a council or police issued ticket you put it in the bin?

Until Oct when clamping is made illegal and instead these tickets are enforceable or.something like that. Unless I'm wrong which would make me happy.
 
I would normally say file it under B for bin, but since someone has unfortunately responded to them, I think you may have to suck this one up.

Is it a photo of the car actually parked, or is it their usual time-stamped entry/exit photos from CCTV?

If the latter, I'd probably be asking them for the proof that you actually parked, since in this case all they can actually prove is that you entered and exited the car park at those times. (You actually drove in and out twice, but there were no spaces either time... right? ;))

Unfortunately I think.you're right. From October the private parking companies can pursue the keeper for the charge instead of the driver. I think the keeper can then name the driver but the part im not sure on is whether the parking company must then pursue the driver once notified.

I can see a big rise coming in the number of cloned number plates.
 
I've had about 15 Parking Eye invoices. Just bin them and don't respond. They send around 3 letters, each getting more scary than the last :)

Guess i'll post this again.
