Parking ticket experts needed

Hi,

I receieved a PCN on 25/05/2011

I contested it online, on the grounds that I was delivering a parcel, and that there was nowhere else to park ( I was dropping off a parcel to a friends house to be collected the next day as I was not going to be at home for the collection to be made, and the only parking near his flat is a layby in town that has daytime parking restrictions on it, it is outside the local off license and everyone always uses it for the off license previously no problems but judging by reports on facebook etc it looks like the parking attendents had a week long purge on this particular area and havent since seemed to bother with it)
anyway I digress,

I received a response on 10th June explaining that I now had until 26th June to pay and after that the charge would increase from £35t o £70. Unless I could provide proof of a substantial delivery that could ot be done in 5 minutes ( i was in spot 10 minutes approx) they may reconsider.
They provided me no contact method so i again went online to ask what they would accept as proof and receieved no response.

Today a letter came to my brother at his address (the previous owner of the car) informing him that he owes £105 for this contravention. This letter also states that he has 14 days from the letter to pay the letter was dated 1st August and it arrived in post yesterday.

What do i do now ?
Can I get out of paying this charge given the circumstances ? ( I assume not but you have to try don't you)
And assuming that I can't what steps do i take to reduce this back down to the original £35 ?

When you mention 'parking restrictions' - what exactly does that mean? Is it a pay & display area and you just decided you weren't giong to pay or is it double yellows, a red route perhaps?
 
parking only allowed between 7pm and 8am (times may be slightly off but that sounds about right) except for coaches, which are allowed 10 minutes at these times.
 
You've appealed on the grounds that you knowingly parked in contravention so you could drop something off at your friends house? Errr...

I suspect there are exceptions for deliveries and collections, as they have considered it acceptable he parked there if he can prove he was delivering something that took more than 5 minutes to deliver.
 
Yep, got that. But he's delivering a parcel which doesn't sound like a "substantial delivery" to me (ie a washing machine, etc).

I may be wrong though.
 
Don't think you're going to have much luck.

If they've said they allow for deliveries and needs to provide proof that delivering said parcel would take longer than 5 minutes then he's stuck.

Because delivering a parcel doesn't.
 
It depends what they will accept as proof. You could probably quite easily forge something, like an invoice from your sole proprietor company.
 
how does that prove it takes longer than 5 minutes though ?

I'm presuming he's already told them it was a parcel and too late to say he was delivering a very heavy delivery now ? ;)

The invoice could be for two things, one of which is a parcel and the other which is large and heavy. If they will accept limited proof then you don't need to be Einstein to build a case around what's already said.
 
you mean that large bulky package which H&S guidelines say requires a pair of wheels that he forget to tell them about ?

Yeah, basically. You'll need to think of something large/heavy but ancillary to a primary item. Besides, the PCN people aren't exactly going to be Hercule Poirot so I suspect they'll barely register he said "parcel" in the first place.
 
ok so assuming I have to pay the fine then, I need to reduce it back down to £35.
They have done something wrong at their end as I responded the same night I got the PCN, online and the response came to my address, they then ignored my second response and sent a reply to my brother's address.

we live in a country where you canr even nip in and drop a parcel at someones house without being fined.

What a farce.

Errr of course you can, if you park legally. :confused:

I think you'll find most countries with parking restrictions tend to enforce them.
