Hi

Last wednesday I parked in Green Park, Bath and purchased a ticket from the machine directly opposite me which more than adequetely covered the time I left my vehicle unattended.

I returned to find I had a 30/60 pound penalty charge notice for being parked in a resident's zone without displaying a valid permit.

This is because (after speaking to a resident there) that one side of the road is for residential parking and the other is for Pay & Display.

However, whilst I parked on the incorrect side of the road, there were no signs indicating residential parking until further up the road in front of my vehicle- so my argument is that the parking areas are inadequetly marked- there was nothing to suggest I was parked illegally in the direct vicinity of my vehicle. Additionally the area is very poorly signposted, making it difficult to tell which zone is which.

I have writtern a letter to the council and recieved a reply basically rejecting my case, and only allowing me to appeal after 28 days. Is there any point in fighting this, or should I just pony up the 30 quid fine?

Signs have to be placed at certain distances from the beginning and end of the parking restriction area. They also need to have repeater signs in between.

I don't the know the distance as it varies on the parking restriction in place, but if you can't see it then you should have a case to appeal against the fine.
 
Can you not pay it first and then appeal it ?

You dont want all sorts of problems for £30. I know its the principle - but you have to take the other factors into consideration.
 
Ok I cannot pay the fine then contest it.

Here is my plan:

  • Check up on technicalities of sign placement & verify
  • Verify that the space is of legal width (Must be at least 1.8m or it cannot be considered a parking space I believe and many are not. If this is the case, I can have the ticket dismissed on this technicality)
  • If I find the signposting to be improper as I believe at the moment, take photos of the area

If I present this to the council after the 28 day period is up I am then able to take the matter further.

Of course if the above are not true, I'll just write them a cheque and a letter projecting my feelings about the council fleecing motorists on technicalities
 
Don't pay, you'll never get it back.

I have been through the appeals process twice in London and both times they rejected my postal appeal immediately and invited me to a personal hearing. I said fine, stated that I had lots of photographic evidence etc. Both times, they dropped the case and let me off about 5 days before the hearing.
