PayPal Dispute for goods not as described.

Sorry, started this thread on my mobile and then lost it all, so give me a minute or two to re-write it...

Nearly four months ago I ordered an XL (160x30 cm) paddling pool for my dog. It was after seeing them around the shops and online, only for one to appear on Instagram at a good price. Not suspiciously low, but a good deal. I made a few cursory checks and went for it. I used Paypal as I thought it would provide a little more protection. It cost just under $30.

After three months of emails back and forth to the seller, it finally arrived. But as you can see from below, it wasn't quite what I was expecting.

I filed a claim with Paypal and after a week or so the seller made an offer of a $9 refund. I refused. It went back to Paypal and they've been investigating for a couple of weeks.

This evening I received this from Paypal:

Who do they think I should contact? The Police? Do I really have to waste their time with this? Trading Standards? My mum?

Wondering if any one else has been through this process and has any advice?

For the sake of $30, I'd let it go and remember unless you're buying from the likes of Amazon etc, it's always cash on collection from these places, whether it's Gumtree, Facebook market place or even Instagram.

Was it an advert on Instagram that takes you to a website to purchase?
 
Sounds like one of these Instagram drop shipping deals, PayPal response is weird though, as above just tell them there's no crime here.

I mean it’s potentially fraud so you could go to the police, but for that amount and an international seller???

Is there any way of escalating within PayPal?
 
Try speaking with someone else at PayPal, their response is ridiculous and there’s no way you should need to report it to anyone other than them to get a full refund.
 
I've replied asking for further guidance from them (Paypal), saying I do not think the UK Police or Trading Standards will be able to provide any support on the matter. The examples Paypal gave of agencies that might be able to assist are all US, eg the FBI!

I also attached the above picture. Hopefully, a human will see it, see sense, and just refund me.

To add insult to injury, Paypal have asked for the information they've requested to be provided by the 6th August 2020.
 
That definitely seems odd.

I've got a dispute open with PayPal now too, waiting for a response. Hopefully they don't respond with this! It's their job to provide the protection that they offer, not to waste police time.

They clearly have a lack of understanding of the consumer rights act, if they are trading in the UK they should adhere to it.

That's clearly not 160x30cm, you are due a refund.

UK law doesn't apply to foreign sellers just like that.

If the OP paid in $ then it doesn't sound like they are a UK registered company.

The OP is entirely dependent on Paypal here. It also doesn't sound like the OP was paying through the UK paypal site.

The pictures wins it for me with the look of total disgust on the dogs face! :D

That's usually the response I get when I tell friends and family about this and offer it as a warning. :D

Maybe I need to go to town on Instagram and see if I can turn it into something positive...my wife set up an Instagram account for the dog and he has quite a few followers! :D
 
If you used your credit card to fund the payment via PayPal then you can do a chargeback via your credit card company.

I chose pay after 14 days and PayPal took the funds directly from my Santander bank account.

For what it's worth, I filled out the form on the CAB website for informing Trading Standards. I'll see what either CAB/TS come back with.

I have no intention of getting in touch with the Police.
 
I've rang paypal before over a disputed item and the guy i spoke to was really sympathetic but was completely hamstrung by their rules and procedures.
what with coronavirus BS everything will be delayed and swept away.
poor dog :P
 
If that paddling pool is 160cm, wow your dog is ******* massive. Money to be earned with a dog that big, get in a circus or down the beach or something.
