Hello!

I sold a phone to someone on eBay and they paid on the 9th January. I promptly sent, he received etc. Last week he sent me a message saying the camera was broken and he'd taken it to a shop who took it apart etc and found the lens to be scratched. I offered a part refund for the inconvenience and just got a narky comment back about how he was going to raise a dispute.

In short, two months down the line can he do this? I know there's a 45 day dispute but is that for faulty items as well??

You shouldn't have given him a refund to start with, and you are right, there is a 45 day period which has passed, tell him to raise a dispute and see how far he gets.

I didn't give him a refund, i offered, was just trying to be nice and all that. If the 45 day rule is for faulties as well then PayPal should just reject.

We will see .

Sorry,i read that wrong :)

Yes,check the paypal rules and im sure you will be fine, just check it is 45 days though.

If a third party has dismantled the phone then imo I wouldn't even entertain the idea of any kind of refund, who is to say the repair shop haven't done the damage to the lens?

And tbh it's been a while so they've had ample chance to return it as faulty without having it dissected , seems to me they've broken it themselves

He should have returned it to you after contacting you first, not allowed someone else to dismantle the phone.

45 days are past, tell him to shove off.

I was offering a part refund simply because i felt bad that there was an issue with the camera. Thanks for the advice though, ill just let him rant away to my message box lol.

Did he leave positive feedback?

I am sure that his period for disputing this is over. Caveat emptor

period for feedback is 60 days, for paypal 45 days.

he can still try chargeback if he paid with his card, but can't see how will that ever be granted, given it's been 2 months and the phone he received was assumingly working just fine.

I'd think it's not even the same phone and he's trying it, like so many others are on bay these days. Once you tell them you got serial numbers recorded, they never reply back.

+1 for post the rants
