Police and taking details...

Was just out on the street having a fag, on my way to put a parking permit on my car round the corner.

The road is iced over and i saw a car coming up the street so i thought i'd wait till it passed and then cross.

Turned out this was a police car who promtly stop and wind the window down.

Police: "what are you doing here?"

Me: "i live here, just going to put a permit on my car."

They look at me as if i'm lying...

Me: "honestly, my car is round the corner and i live up the street. Look, here is my house key, my car key..."

Police: "We need to take your details..."

Me: "Is there any reason for this? I'd rather you didn't..."

After them still not believing me i pull out my Driving licence with my address on it to prove i live around the corner.

The officer takes the card off me and promtly start to write my details down even tho i said i didn't want them to.

Can they do this? I know it really doesn't matter either way and my life won't end but surely they need my permission to do so?

The reason i was so reluctant to do so was the fact that it was bloody cold and i wanted to get back inside asap, rather than fafing around with the police for no good reason.

Yup, of course they can, they may have information of something that has happened in the area and you match the description, they were probably waiting to see if you would do a runner :)
 
No, they can't, they have no legal right to do that (even if you're being searched you can still refuse to give your details). The anti-terrorism act only applies in specific areas designated by the home secretary, and they must inform you that it's under the terrorism act.
 
There are a few things that you can't refuse, like taking a breatherliser test when stopped by the police.

Look at it from his point of view, some punk is having a fag on the street corner, he go and ask a couple of questions, the punk is being lippy.

Not saying OP is the punk :p

actually, you can refuse a breathaliser test, but you have to go back to the station then and have a blood alcohol test instead. Mainly because the law is written in a way that it's blood alcohol content that is the deciding factor, also because breathaliser tests aren't fully accurate (e.g. you can fail them if you've used mouthwash)

At the end of the day it just **** me off that i said no, and they did it anyway.

And btw, i'm 6ft 5 with light medium length hair. I doubt i could have matched any description :)

it is an arrestable offence to refuse a breathalyser, it carry a maximum of £1000 fine and 4 points on your licence. There are situations where you can refuse but it is not advisable to do so. If you refuse, no doubt you'll get taken back to the station anyway, so if you never been drinking then there really is not much reason to refuse. If you just used mouth wash then do it anyway, and the blood test will clear you, if you refuse then you risk the fine and points even if you have not been drinking.
 
You don't have to give them any personal details at all, just tell them why you're where you are and that's all. It's called a "Stop & Account", after which you should get a card telling you who stopped and asked you.

I tried to tell them who i was, where i lived & what i was doing, even showed them proof.

Its anoying, i'm no 17 year old wanna be gangster hanging around the streets. I thought being mid 20's these things wouldn't happen any more.

The fact that they abused their power and took my details peeves me off. I am considering complaining but i know that the complaint wouldn't come to anything, obviously. So no point really.

The most annoying thing is i try and help the police out as much as i can and always ring them when i see something dodgy going on. Maybe i wont bother anymore...
 
When we ask someone to account for their presence in area, behaviour, action or possessions we're required to fill out a 5090X (Stop & Account) form. You don't have to give your name and address, they're not required now. You should have been given a yellow slip with all the details you supplied :). The officer shouldn't have written down your details if you didn't want to supply them.
