Problem with insurance claim

About a month ago I was sitting in traffic, and a lorry in the right hand lane tried to filter in to my lane by driving in to my car door. I parked up and he accused me of cutting him up, I pointed out I'd been in front of him the whole time and there was no where for him to filter in (it was a solid line of traffic). We exchanged details and left. I phoned my insurance company to make a claim through his insurance later that day. I got a quote as requested and about two weeks later his insurance sent out an assessor to check the car, verbally he agreed with the repair procedure and then left.

Now I have been called by my insurance company and been told that his insurance company are claiming an 'indemnity issue' which could take months to resolve in the mean time they won't admit liability or deal with the claim. My insurance recommend I go through them, pay the excess and get it repaired, however they agree this would effect my policy when it came to renewal.

I'm planning on selling the car in the next few months so really need it repaired and don't want to mess up my insurance when it comes to getting a quote for a new one.

Any one had a similar issue, any advice?

Contact your insurer and ask what indemnity issue means

It may be the other driver is not correctly insured, so would not be covered
 
Depends on the reason for being uninsured.

I could take out a policy and put in incorrect info to get a cheaper price, I have an insurance policy but as soon as I am involved in an accident and make a claim they would turn around and say the policy is void due to all the incorrect info. I am uninsured.

However I still had the policy and the company would have to make any third party payments (and then chase me for the money)
