Pulled for not wearing a seatbelt

Thats the thing about assumptions, funny enough....

What if a traffic cop said, oh look and untaxed car, but its going to be ok, odds are he will tax it next week....

Clearly this would be the wrong way of going about things.

An untaxed car on the road is an offence.

I didn't commit any offence.

He didn't need to pull me.
 
Not really, its at the officers discretion at what action to take, like when some people are caught doing 90mph on the motorway, sometimes they get 3 points, other times they get a talking to and thats it.

Its like when i've being pulled over in the past, he could have give me a £30 fine, but he just spoke to me instead.

/on topic - I naturally get in, put seat belt on, turn key, wiggle my gearstick (oh matron) and then check mirrors... just the way I was taught and now a natural reaction.

I guess its the double spacing installed in me when doing my degree.

I do.This time I didn't I was in a car park in a doctors surgery. With man Flu.:(
 
So a copper who was well within his rights to issue you with a fixed penalty notice but decided instead just to have a chat is, as a result, an idiot?

He did have grounds to give you an FPN, as you drove forwards on public grounds that connect to the queens highway.

Its a Private car park for Surgery staff and patients.

Not for public parking of any kind.

I live in a house in the country with a long driveway.Does that mean I can get a fine driving up that without my seatbelt on?

Its a public carpark for the public who are visiting the surgery, it connects to the highway, and therefore can be attributed to the rules laid out in the highway code.

Are you actually sure it was private land, im guessing its not as private as you like ot think, especially as its connected to a public road.
Also, there was the possibility that you could have drove off without belt on, copper was pre-emptively reminding you that you should wear your seatbelt.

I'll highlight a key word that you seem to misunderstand. This indicates that the PUBLIC use the carpark, and that therefore the carpark is open to the PUBLIC. Given that it is also DIRECTLY attached to the PUBLIC HIGHWAY, it is goverened by the highway code.

Went the doctors parked up in the car park.

Came out got in my car reversed with belt off.

Came to the car park entrance pulled onto road and put belt on copper stopped

me saying I was driving without a seatbelt.

did you drive onto the road without the belt on and then pull over to put it on? or did you put it on whilst moving?
reversing without a seatbelt on is ok, its the driving forward after a maneuver on the highway that is not allowed.

also he is doing his job, its nothing to do with being bored, i bet thieves say the same.
 
Easyrider a lot of car parks that have public access are covered under the road traffic 1972 that does give the police the right to treat as a public highway,other wise if you had an RTA you could not make a claim.
