Putting in a claim

No, the college was aware in the first place as he stated, and there were previous complaints on it, but no action was taken. Meaning he has good cause to put a claim in end of story.

Technically, but he could also stop being a whinger, and just say 'oh, I fell over and hurt myself' and get on with his life.

Why should the college give him money?

Do you think someone should immediately run out and mop every stair in the country the second it stops raining?

Or should you just open your eyes and try and not fall over?

People always try and put blame on someone else and get money out of them for everything, it makes me sick.

He fell over, he should just get over it.

FFS don't claim. If you do, give the winnings to charity.

People like you push my insurance costs up and deserve a good hard slap in the mush.

No, im just looking at it in a different perspective. Yes he could just pipe down but it looks like the college isn't acting.

But he asked for help, I was just telling how it is. Its up to him if he puts a claim in or not but at the end of the day he has the evidence and right to put in a claim.

They're a college, they've got more to worry about than mopping the steps so absent-minded kids don't fall down them.

Seriously, look at it from THIS perspective.

They offer this kid an education that to him is in effect almost free, he's attending this, falls over on wet steps (who's fault? his) and he wants to SUE THEM?

Pathetic.

American.

Reading this it seems that the steps were outside. If so grow up & take some responsibility for your own actions. What you going to do next, sue God because it was raining & you got a cold. Don't send this country the way of America.

I'm with the don't claim camp here I'm afraid. The steps were wet and you slipped, boo frigging hoo. You should have been more careful, end of story.

I know that im not disagreeing with you. Colleges are providing him with an education which he should value. However they are oblicated to the health and safety act.

Again im not disputing that he should or should not claim im just telling him what he requested to know. If it was me I probly wouldn't claim since his shoulder just popped out of place. But I'd make sure that they do something about the steps as others have hurt themself clearly showing a hazard.

Speak to a lawyer (for gods sake don't go to one of those accident direct people on the telly). Tell them what happened and see what they say.

Also, get yourself onto the HSSE group at your Uni (they should have one) and use this to push the Uni forward to better HSSE standards.

Yeah, but if they dont pay the price then nothing will change. I broke my wrist in school due to a badly maintained floor, but didnt try for compensation, and it was still the same 2 years later.

Claim - and ignore the "people like you..." Muppet's  Yes, a roll eyes.

What if the next person slips, hits their head and dies? The College should be a safe place to be for thousands of people and the college has a responsibility to keep them all safe while on the premises. Even if you put in a claim and get nowhere you can bet your bottom the college will still quickly get the steps sorted before the next claim.

Right im sorry for upsetting a lot of people. Fair enough the steps were wet coming out of the building and this was because it had been raining but how can you say i should be more carefull?! The security guard has said a lot of people have fallen down these stairs and nothing has ever been done so it is a known problem that has never been fixed. The stairs are actually metal not concrete like the rest of the campus and it seems they are an accident blacksopt. I diddn't fall out of my own stupidity or carelessness, i wasn't running or acting the fool just walking to my car with my mate.

I have suffered no financial loss apart from i wont get my Adult Learning Grant for not attending next week which isn't a big deal (£30). I cant drive for a few weeks until it settles down, i get more movement and i can strengthen it up again. I also cant really sleep because of the pain during the night of constantly rolling on it.

Where are you based? Might be able to recommend a decent solicitor near you, you definitely have a valid claim so go ahead. To make it easier do the following:

1. Keep a file of any receipts for costs incurred as a result of the injury. This includes receipts for painkillers, taxis, all sorts.
2. Keep an injury diary - documenting how you're getting on each day, what help you received and such like.
3. If you haven't already, get the security guards details as he'll probably provide a witness statement for you

Depending on whether the college admit liability (which they should do pretty quickly from the sounds of it tbh) you're probably looking at about a year before you receive any money, if they decide to contest it, it could be 2-3 years, also depends on the prognosis when you get your medical examination.

Hell yes claim, these places don't do what they know they must, until it stings them. You wont get as a big a claim as some one who has never injured t6here shoulder again. But then as the problem was known about and not acted on, they might increase the payment just to send a warning to the collage.

Visit the college admin (or whoever is responsible) and inform them that you will be making a claim against them unless they rectify the problem asap. Give them a deadline.

No need for you to claim.

i know nothing said:

So he's financially out, pain killers, inconvenience what ever, the collage new the problem and ignored it and you think there's no reason to claim. I agree there's far to many claims these days, however this one is reasonable.

normally i`m against people claiming over silly things, like slipping in the rain! but... if the steps were known to be dangerously slippy when wet and nothing had been done to rectify it, then put in a claim, maybe that will teach them to fix things sooner
