question about TUPE

the company I work for has lost a contract, I am changing employer under this TUPE agreement?
the company who is getting the contract pays more than my current employer, does TUPE mean I have to stay on the same money as now?
I will find out eventually, been told we will get letters etc, sure someone here knows though...
 
Yes, the new employer can pay you more money under TUPE, as long as the company youre transferring from is in agreement to pay and T&C's....from what I remember, I could be wrong.
 
I've been TUPE'd into my current role. TUPE should guarantee you at least the benefits (pay, pension, T&Cs) that you get now. Note: at least.

Regarding the difference in pay - if I were you, I'd push for the best you can get. Don't just accept the first or second offer on the table. Look at their organisational structure and any closely-matched roles, find a role you can perform that pays a fair and good salary in your eyes, and negotiate with them.

I didn't challenge my new role offer during the TUPE process - I got a slight payrise but nothing worth shouting about. A few years down the road and my salary is still far lower than my equivalents in the company I joined.

Don't forget the very important caveat: TUPE only applies at the point of transfer. The very next day your new employers can then bend you over and take you if they so wish. Don't assume TUPE is any form of long-term guarantee.

Unfortunatly TUPE offers the employee very little.

I was going to TUPE as I had the same thing happen to me, a contract was lost and went to another company.

They can SHAFT you very easy in a TUPE situation so be VERY carefull.

If I remember correctly they can make you travel up to 35 miles from your current location and this is deemed "fair"

They can decide to pay you exactly what your on now,and I very much doubt the company will pay you more.

I myself told them to go screw themselves and found myself another job 3 weeks before the TUPE date anyway.

EDIT - What the guy said above is very true too, they can move you over on the wage your on at the moment and the next day decide that they no longer want to do this and reduce your wages or do anything they please

I say again TUPE DOES NOT PROTECT YOU LIKE THEY SAY IT DOES.

It would depends on the T&C of the TUPE transfer, it could be just as easy as your current contract being transfered to the new employer in its current state. So you'd essentially be on the same wage / everything just in a new location with the new firm.
