Just a quick question as im not too sure myself about it.

About a week ago i bought something from ebay, got it the next day but decided to send it back for a refund which was fine with the seller. Now he says that he wont refund the paypal fees ie i take it his fees that he had to pay for listing the item. Anyways i didnt agree with this and checked the listing where i bought the item and it doesnt say anywhere on there that, if i returned the item that i wouldnt get the full refund.
I can understand him not wanting to refund the postage costs but the item was £540 and hes saying now that he will only refund £500 back.

So where do i stand on this??, is he entitled to do such a thing or not??

TIA:)

He will only have incurred the Paypal fees if you paid by Paypal.

If you did then he should refund via Paypal and you will get a 100% refund.

If he's talking about ebay fees (there are two separate sets of fees) then these are also refundable I think, apart from the listing fee which is only about £2-3.

So unless he's talking about postage costs, which probably will be non-refundable, then he's having you on.

You messed him around by asking for a refund, why should he have to foot the bill for your indecisiveness? Totally justified if you ask me, would you want to loose £40 because someone changed their mind?

Cheers mate for the advice, he's being an utter **** so might have to consult my lawyer about what to do. I refuse to pay £40 for something that i was entitled to return within 7 days without incurring extra fees. If it was £10 or something then i would let it go but it isnt and its the principle of the matter. Ive returned plenty of things from ebay without having to pay paypal/ebay fees etc...always got 100% refund.

Was it an auction or a fixed price? Is the seller a private individual or a business? These things determine whether you have any rights under the DSR.

In each paypal payment you recieve, theres an option inside the details to refund the buyer. If this is what he has done then he isn't to blame, clicking this button has paypal fees aswell so it looks like hes in the right. Though, £40 seems a little much.

nope, when you refund someone, you get the fees back

Why don't you just file a case at PayPal? Stating you have a brand new returned item that the seller allowed you to return and he will not give a full refund.

He will get 100% refunded PayPal fees once he refunds your money, he will also get refunds from eBay he just needs to go through a simple process.
