R7 3800X IHS damage and cooling

This is a pic from my phone, so sorry it's not great. I am sure I can feel a slight protrusion of metal as it's slightly rough to the touch. I have it running and the temps seem ok, but not great.
 
Thanks for all the great comments! I upgraded the cooler from the Wraith Prism to the Scythe Mugen 5 as gaming cpu temps were hitting 79 after an hour playing COD MW. It was in a crappy cheap case at the time, but even taking off the whole case side panel made no difference to temps. It now sits in a Lian Li 011 Dynamic case (not air cooled designed I know), but it has 9 120mm fans, which I have tried in various configurations. It has still hit 76 top with a 23 ambient. It generally runs several degrees lower than this as it was an unusually hot day here in the UK when it hit 76. I am confident that the thermal paste is good. It just seems to me that it should be running cooler. Is this due to the damage on the IHS?
 
Thank you all again for your comments. I agree now that there is no point messing around with this CPU. I have another undamaged one running in the exact same setup and the temps are almost exactly the same. I knew I would not have a leg to stand on with warranty. I will just make sure I use plenty of thermal paste!
