Resitting your test after a ban

One of my housemates is going to court on Thursday and could potentially end up with 12 points on her license, 3 x 3 points for speeding and potentially another 3 for running a red light. If she does get 12 points (and banned) how long before she can resit her test and will the points still be on her license?

the points will be on her license for the usual 3 years plus one dormant year from the date of conviction.
perhaps you should book her in for an eye test during her ban as it seems she has difficulty seeing minor pieces of road furniture like speed limit signs/traffic lights etc.

I thought that if you get 12 points and banned you have to resit your test.
Nay, thats just the 6-and-out rule in the first 2 years of driving I think :)

As Gilly said, it's only if you accrue six points within two years of passing that you lose your license and have to resit the test. Totting up will see her banned for a minimum of 6 months and more likely 12, but her license will be clean when the ban is over. I tend to agree with TDS here, she needs to stop speeding and running red lights. I think her impending ban is going to be a harsh reality check.

PS. Do let us know how she gets on so we can snigger ;) :D

when you're right it's easy to take the moral high ground.
speeding may be one thing, but running a red light is ALWAYS dangerous.

:p

Yup, running a red light is usually very very dangerous... but with some of the banks of lights on top of each other these days its VERY easy to do it by accident..

apparently i'm climbing back onto the high horse again but i can honestly say i've never done that, but bearing in mind the girl the OP mentions seems to go everywhere at warp factor nine i can see how she may have noticed it red at the last minute.
it doesn't make it excusable or any more safe though.

Cheers for the info guys. For the record all three speeding offences are over a year old and since receiving them she has completely changed her driving style and no longer goes over the speed limit ANYWHERE. I'm not too sure what happened with the red light so I won't comment.

Well you must be a driving god... lol

Nah seriously tho, don't tempt fate, driving somewhere you don't know it can be very easy to do by mistake...

;)

For those that are interested my housemate hired a solicitor on Monday and her court appearance was today.

With the solicitor speaking on her behalf and with letters from her company she was able "get away with" 3 points giving her 12 in total but no ban. She also has to pay £200 costs and solicitor fees.

Expensive lesson but I recon she could out bore the majority of the anti-speed members on here with her firm belief that speeding is bad

I can only assume that some of her existing 9 points were obtained between three and four years ago, so although they'd still be on her license they wouldn't count for totting up purposes.

If this is the case then she's not been especially lucky, she's received the standard 3 points that this particular offence attracts. If all of the existing 9 points were obtained within the past three years however, I fail to see how she could have been allowed to escape a ban and I was under the impression that 12 points in a three year period was an automatic ban and there was no escaping this.
