Rights on returning a laptop bought in store

Bought a 256GB Surface Pro 3 just over 4 weeks ago - IN STORE at a shop that isn't OCUK.

I've been trying it and I'm not too happy with it. Some may be personal preference or me being fussy. Would any of my concerns entitle me to a refund? Or am I just meant to put up with it.


Issues:

  • There is a colour banding issue on dark images / videos. Researched this and other people have same issue, due I believe to customised version of Intel Drivers specifically for Surface. Using standard intel drivers causes its own performance issues so there is no known fix!!!
  • Battery life isn't good. Maybe 3 hours if watching videos. I'm sure its sold as about 8 hours?
  • It gets hot if you watch videos / 720p youtube videos for more than an hour (fan starts going)

Is this enough to get a refund?

What shop? Some have different returns policies.

I think as long as you don't link to them it's ok.

Unfortunately dsr isn't applicable (or whatever the new ones called) so we'll have to check returns.

Comes down to how leniant the store clerk/manager is and if they like arguing! somtimes they'll argue, sometimes they cant be arsed and will just give you a refund! if they argue you could say it isnt fit for purpose and go down that route but yeah just comes down to the store you bought it from and who you deal with at the end of the day! might as well try! but as other people say you dont actually have any rights unles sthe item is not fit for purposs, or the shop has some satisfaction guarantee within the 4 weeks you've had it!

You have no "right" to return it unless there was some sort of satisfaction guarantee/ returns policy offered by the store. Or if it's faulty, of course.

Battery life seems in line with that promised - isn't the 8 hour life for browsing rather than video?
 
So basically after using it for a month you've decided it's not really for you and you would rather have some money, sounds like you should be listing it for sale not bothering the shop you bought it from...
 
John Lewis have a very, very lenient returns policy. Unless you catch the staff on a bad day they will give you your money back.

I returned a jacket after six months because it was shedding its insides, got a full refund.
 
Ergh I missed the 4 weeks part. You'll be very lucky to get anything back but john Lewis iirc are quite blasé on returns.

Fingers crossed.
 
John Lewis are known for their customer service, so go on and explain your issues and the chances are you'll walk out with your monies.
 
Since you bought it in-store, unless it's faulty, it's basically down to the returns policy of the store.

Just whatever you do, don't go in there all guns blazing, start yelling at the girl at the counter who's trying to help you, then storm out in a childish rage, hurling the laptop towards the counter, literally brushing the side of the head of the guy who's stood there trying to buy something*.

This is a true story, was stood at the counter in Argos, minding my own business, waiting for my item, with my 2 year old sat on the counter in front of me. He wanted down, so I picked him up, bent down to put him on the floor, and felt something brush my hair, and then a loud crash as a netbook flew through the space where my little boy's head had just been, and slammed into the wall behind...

Let's just say the guy was very lucky he hadn't still been sitting there, or it probably would have been me being taken away by the police instead of him! :eek:

The banding issue isn't acceptable and I would argue was a fault. If I relied on accurate image display for my job, I would have returned it straight away.

Other than that though yes, I think it's crap.

If you relied on an accurate image display you wouldn't have bought a surface pro 3 :D.
 
John Lewis might just issues a gift card however, which they are well within their right to do, unless it is actually faulty.
 
Unfortunately, OP it sounds like by the letter of the law you aren't entitle to a refund. As people have said though, worth a chat with John Lewis. Think the least they will do is offer you an exchange as they do go above and beyond on these things!
