RMA'd graphics card, returned to me.

I'd assume ocuk would do the correct thing here and inspect the card themselves, although depsite still using them I have absolutely no faith in there customer service skills since my xspc issue.

They obviously inspected it very briefly and concluded I had pulled the connector off, when I phoned them up to explain it came to me like that, the guy on the phone was having absolutely none of it tho, it was clear I was in the wrong.
 
Well they can't, the onus is on them by law to prove that it wasn't faulty prior to sale. They have to take it back. If they don't you can take them to small claims. Send them a letter/email stating you believe yourself to be within your rights for a full refund. If the reply is unsatisfactory reply back to them again stating you'd like to give them the chance to reconsider as you are considering small claims court. If they still don't budge then inform them again that you have initiated proceedings. They need to pay for full legal representation as a registered company, so full blown lawyers fees in the thousands. You pay, well I'm not sure, last time I had to go down that road it was £70. Chances are they may just refund as it's less cost, hassle and they are not seen as being on the wrong side of a legal dispute.

Thanks for the advice, hopefully it won’t come to that but I’d be prepared to go down that route should I need to.
 
Not fully sure on how RMA works. Could the OP send it back again, but this time as faulty instead of unwanted?

If they do accept it as faulty maybe then they will offer a refund.
 
I think that at this point you should take as many pictures of the manufacturing defect as if this is solid then it must have left the factory like this and then post them to OC in a support thread linking this thread. Ocuk are normally very fair and may well reconsider your case.

Thank you, I have quite a few photos, I'll try a video see if that shows it in more detail.

I have sent an email to James Bailey (assistant returns manager) linking this thread, reiterating the issue. Hopefully ill get a positive response.
