Roundabout - who at fault (theoretical)

I rekon the claim would just go 50/50 and you'll both end up loosing out on NCB and your excess....

At least you'll know you've taken one speeder off the road.
 
Ok, turning this argument on its head - how far do you have to be on the roundabout for the blame to pass to the car coming from the right?

I think that's irrellevant, you need to give way to cars *approaching* the roundabout from your right and as said part of that is your judgement on the speed they are travelling..

What really hacks me off though on roundabouts is people in the wrong lane and cutting across you - either in the left lane and going round or in the right and turning left :Mad:

Rule 185: Give priority to traffic approaching from your right.

That's the extent of the law on the matter. I'd say you could argue this and make a case for the fact you entered the roundabout with no approaching traffic from the right. Once on it, some idiot doing 50 in a 30 and hitting you side-on will need to be judged on a case by case basis as some roundabouts have some really curvy entrances that don't lend well to visibility, particularly when plonkers are involved.

Surely you supposed to stop at the roundabout and check its clear before you enter it anyway, not just barrel on through.
Even despite this, you can get caught out with speeding drivers entering curvy entrances making judgement impossible. Oh, and rule 185 doesn't say you need to stop. :)

On a case by case basis, having seen the vehicle you're at fault as you were in a position to make a judgement on it.
 
Probably your fault for insurance purposes. Having said that, on the odd occasion when I cane it around a roundabout and get the inevitable people misjudging my speed and pulling out, I always consider it to be my own fault and wouldn't dream of chastising them.
