need some advice....

2 months ago my wife hit a teenage girl who ran out in front of her, luckly she was only doing about 15mph and the girl was pretty much un-injured. We contacted the parents in the evening and explained about some bodywork damage that she had caused to the car. We got an estimate as the parents said they would pay, it came out at about £500. The couple then asked to get a second qoute, and thats the last we heard from them. We've left messages over the following few weeks or so which they didnt return. Then they eventually called us (about 4 weeks ago) to say that they had been in touch with their insurance company and had been told not to contact us, I called them again today to chase it as we havent heard anything and they said that it was still with their insurance company but gave me the impression that nothing was actually being done and they were hoping we'd forget. I'm thinking of getting a solicitor involved but need some advice from you guys...
 
What have your insurance company said?
As the girl was a pedestrian, what insurance are they dealing with? Sounds like you're being fobbed off and it needs to go via your insurance if it isn't already.
 
Yep, call your insurance company. If their insurance had been informed, they would have informed yours and and eventually you.
 
we didnt want to get the insurance company involved if possible as it sounded like they were going to be amicable about it and sort it out. If she was a pedestrian wouldnt it go against our insurance as she isnt insured?

If she was a pedestrian i can't see how she has any insurance company to "involve".

If it was me i'd be instructing a solicitor. That's just who i am though :D
 
Err if she was a pedestrian then it has nothing to do with their insurance. If you want the money back and they're not paying you have to take them to the small claims courts.
 
My missus hit a young 'un in very much the same sort of circumstances and ended up paying the full bill as the child is a minor and cannot be held liable for the damage apparently. They have no legal responsibility to pay iirc and I very much doubt home insurance would cover it.

The mother openly admitted it, the kid admitted it, the police stated it wasn't her fault, hell the kid had ridden his bike into the SIDE of her car and she still had to claim on her own insurance.

No insurance company other than yours is going to pay out for this. As people have already said, you'll need to go to court to stand a hope of recovering any money from this. If the girl you hit is under 18 you've got no chance whatsoever.

yet another reason why everyone should have insurance then !

spoke to her insurance today and basically we will have to pay for the lot regardless of her age. This really sucks a**e, not happy would be putting it mildly, I'm going to speak to my solicitor on Monday to see what they say,, and to top it off I got rear ended on the way to work this morning... Kama gotta love it ;)
 
If I hit a pedestrian, the last thing I would be doing is trying to reclaim the cost of damages from them. Id be glad I wasnt being sued!
 
i thought pedestrians always had the right of way, so even if she was over 18 it would still be the drivers fault?
 
dont think so, the police didnt think so either, basically she admitted to running out without looking while playing with her bother with supersoakers. We are glad that she wasnt killed of course we are, but we've now got a £500 bill because of a chavy (yes she actually was) girl who didnt know how to cross a road, so why should I pay? it wasnt our fault, its total injustice. The same goes for if your car is totalled and the other guy has no insurance, your screwed for no-fault of your own,
