sacking someone on sick

Hi all,

Have an issue at work.

We had a girl start middle of last year and was let go during her probation for sickness & attendance issues.

However, at some discussions they gave her a job back in the same team.

This was 20th oct, since then she has had a couple of days sick and a total 55 days signed off. she is still on probation.

Can you legally sack her without any repercussions even though she is signed off?

It is possible under the right circumstances, but I doubt you have that info if you aren't on the management team of your company.
 
Short answer - yes.

Although there's a lot of red tape to go through such as size of business, whether the position is essential to the company and as a result of person having time off is having an impact on the business, etc.

But yes, it can be done.
 
Been a while since i was involved with personnel, but from what i can remember, if the person has worked for you for less than 12 months your fairly safe doing so. After a year is when employees start gaining more 'rights'.

You can sack someone when they are signed off, but you need to ensure all statutory obligations are met (including under the DDA) and ensure that there is a robust policy in place and that it's followed correctly.
 
All she's got to say though is "women's problems" and the whole thing will be swept under the rug. It happened with a woman I used to work with, she was notorious for constantly having so called "sick days" and when questioned about it she just said "I can't help it, it's woman problems"!

The truth was, these sick days just happened to coincide with her husband being at home from work yet, because the head of dept. didn't want to be seen as sexist in the current climate, the matter was quietly laid to one side.

Which is down to (as it usually is) bad management, not the law.

Wow, he was spineless then. I've had a team member use "womens problems" as an excuse before. I ask for all the gory details which normally puts an end to it.
If all the other women can manage satisfactory attendance despite being afflicted with womanism, why can't she?

that's whats so funny about women wanting equal rights, as soon as they want a benefit they use the 'woman' card

just like all 'races' being equal, until mister african/english man sees the chance to make a quick buck.
 
surely if somesones not doing the job they are paid to do thats grounds for dissmissal especially in the probational period ? and secondly surely they would need a doctors note to prove any absences ?

At least half the full time retards at my local Tesco are frequently off here and there with all sorts of rubbish like stress and depression. They are just the sort of people who would not know a hard weeks work if it hit them in the face.

Get rid of her, she clearly is not going to book her ideas up.
You sacked for for attendance and she is on probation and taking the **** again with sick days.
