bought a laptop in oct, its now totally messed up, doesnt even turn on anymore.

If I take it back is the seller allowed to send it off for repair?

They're allowed to; they're allowed to paint themselves blue and say whibble, this does not nessesarily mean they will.

are they legally entitled to send it off for repair rather than refund it?
the DTI website doesnt seem to mention much, but I recall reading something about them bieng allowed to repair it rather than refund.
 
your better off ringing the company who made the laptop and getting them to repair it under the warranty

(or just giving it to me for free:D)
 
Technically, the Sale of Goods Act provides that you are entitled to a full refund. If it wasn't satisfactory quality they have breached an implied condition of the contract and the contract can be rescinded.

However, someone linked to some regulations last time this came up and whilst I don't think it contradicted the above, I would rather see it again before I say for sure.
