Scammed by a retailer ?

Ordered a 3080ti from a well known big company due to having "store credit" the item arrived today box was very battered and I thought oh it's a return surely opened box card in bag no seals and the wrong GPU in.

I have contacted and return straight way photo graphed everything. Just wondering where I stand on this as essentially it's my word Vs there's.

The parcel weight was to low to be the true card noted on the parcel both ways.
Anyone experienced this? Why the hell was I sent an unsealed box

There have been so many scams it’s going to be a tough one. Did the delivery driver take photos of the battered box?
 
I'd say it's likely a case they haven't checked their returns properly and other than the box being damaged they assumed everything else was fine.

If they are a good retailer I'm sure with the weight difference and the other issues you mentioned you'll either recieve a new card or a refund.

Did you pay by credit card?

I'm going to contact trading standards Monday and open a case to assist in the matter.
The card in it had new stickers on etc but wasn't the correct card.
I've also screen have screen shots on there forum where someone has opened a thread with the same issue within the last three days.
I assume this is as u say a return scam or warehouse swapping.

If the company in question has refused to help you then trading standards is the correct next course of action.

If what you ordered was not delivered then you have all the same rights as if you paid via a card normally, regardless of whether it was store credit or not.

They entered a contract with you to deliver that item and accepted the store credit as payment.

You dont say if they have replied yet, give them every opportunity to make things right before you take further action.

Are you not jumping the gun a bit? Why don't you wait for a reply from the company before contacting trading standards
 
Yes I will give them the opportunity just extremely stressed about the situation and worried as it's a huge amount of money
It's something I never considered to happen
I sent the item back recorded returns
I was advised to open a case with TS straight away by a friend but I will hold back till hear from said company once they have it back
They didn't seem phased at all on the phone it was a yes just return with this label.
I'm gpu less now which also is crap as just upgraded pc and the last piece of the jigsaw was the 3080 was looking forward to a great weekend
 
So they're fully cooperating because they asked you to return it so they can rectify the mistake? There's no problem then.

If they refuse then get trading standards but currently they've done nothing wrong. No crime has been committed at all yet.

No problem so far unless they refuse the return due to wrong card like the egg shop in America did to some people according the Gamers Nexus videos. Hopefully that won't happen though and I'd try not to worry unless the retailer gives you reason to. At the moment everything seems to be going as it should :)

Out of interest which card did you receive instead of the 3080?
 
I'm hopefully they won't especially given the condition of the box it looked like it has been in the sun too long and kicked up and down a field.
Definitely not a new product and not sealed etc

Hopefully a refund will be back asap and I can buy again but unfortunately won't have as much budget for a ti.
I'm looking to skip the next lot of cards and buy now and use I know it's not the best time to buy one but I want to enjoy my pc.
Without my credit I'd be looking at a 3070ti I guess for 1440p UW
 
Trading standards no longer deal with individual cases havent for a long time, they ask you to contact CAB.

Unfortunately this isn't an isolated incident and a lot of people claim this has happened to then with everthing from phones to laptops.

Photos mean nothing, easily staged so are not are not the evedence you hope will prove your point.

The problem is they don't know you arent trying it on so the default position is "we sent the correct item" so claim denied.

You might get lucky if there has been a few complaints about this and might look internally for the culprit. They would refund if they knew someone internally was at it.
