edit: As an aside, if you have a phone with a voice note recording facility, I'd suggest you record all conversations you have when you get pulled by the police. Thanks to this thread I'm going to start doing it.

Can't see how that's help as I doubt you'd be able to use it as evidence

I was 'given' a section 59 a few years ago for having a noisy exhaust, although from poking around i dont think i was official as i didnt receive a peice of paper and the issuing officer didnt have a hat on.

What's his hat got to do with anything?

a police man stopped me about early january and issued me with a producer which just had *produce documents* checked and not offence. he said he was issuing me with a section 59 but I had no paper work etc and havent recieved anything through the post ? does this mean he didnt actually give me one or does it not work like that?
 
I had never heard of these until a friend of mine got one for wheel spinning out of a car park and up a hill in his Zaf GSi. It sounded like a pretty heavy offence as the copper told him that he needed to be a good boy from then on as his card was marked and next time they nicked him they would crush the Zaf.

Totally unsure as to whether they could do that, sounds like brown smelly male cow stuff to me.


Burnsy : Apparently plod have to have their hat on when they nick you. I was most surprised to find this out but the ex was a copper and he reckons it is 100% true. I can't see how it makes any difference personally.

they only crush it if you dont pay the fees for siezure + storage of the vehicle. But they can and will sieze it on the second warning, then charge you up to £250 to get it back, minimum is £160 i think.
 
I do remember reading a while back that the law had changed on Section 59s for the worse.

Apparently a random member of the public complaining about your driving is enough to get you slapped with one. No appeals process, no evidence, heck, a police officer doesn't even have to witness the alleged incident! Just think, a few complaints from a busy body who dislikes you/your car could be enough to have your ride seized regardless of what you were or were not doing. Awesome, huh?

I was expecting to get absoultely hammered with tugs when I bought the GTI. Young lad in SE London driving a 80s hatchback with a fart can, I couldn't help but think of the worst. Luckily no problems to far. I do know the second I get hit with a S59 the car is up for sale - Remember, a S59 sticks to the vehicle, not the driver!
