Septic tank removal

My parents have a septic tank on their land that was shared with the neighbor, since about 1984\5 they built a new home and have never used it since. The neighbors pay for the emptying the tank and for the last 35 years my dad has maintained the tank and paid for everything other than the emptying of the tanks.

I want to get rid of it, the tanks is old my dads guess is 60+ years old and is on it's last legs eventually I'll end up sorting this out one way of the other. The neighbors garden is big and have more than enough room for a new tank. At the moment I'm fact finding, I've got the deeds from the land registry and nowhere does it mention anything about the tanks in fact other than changing hands it mentions very little. Will the original deeds be more detailed? my dad always said the neighbors have access to use our lonning to fill their oil tank but their was no mention in the deeds that I downloaded from the land registry.

Anyone have any experience with removing shared septic tank?
 
The best you can do is to rifle through the titles as you have done. My PPR hosts a shared septic tank (historic, as this one is) and the title clearly states that i am responsible for it, and the transit of the neighbouring properties' waste.

These days we have a mains sewer, so my responsibility is just the transit side of things across my land to the sewer, but it is clearly stated in my title.

My take on this would be that if there is absolutely *no* mention of this at all within your title documents, then you should approach delicately with the neighbour to say that it is EOL, and that you do not require the use of it and that they will need to make arrangements to divert their waste.
