Shift Work

Hello,

If I'm on a 5pm-10pm shift and at 8pm the manager tells me to go home can I turn around and say no I want to finish the rest of my shift?

My brother works at Dominos was on a 5-close (11 to 12) and gets a lift home from a driver at the end of his shift. He rang me at 10pm asking for a lift home. I told him I cannot because I have plans and to tell the manager you want to finish your shift.

My opinion is they cannot just force him to finish his shift because it screws up his plans to get home and probably won't have been able to get transport because my parents were out, I could have been at work, etc. It's not his fault they cannot plan rotas properly and should have provided him transport home like they were originally going to.

I'm no expert on employment law, but i would say that if you have an employment contract stating a set working hours schedule then the employer has to adhere to it. If you are paid by the hour will no contract then he can say when you leave.

Also, it is not the employers responsibility to provide transport to and from the place of work.

A local potato factory actually runs two mini buses for its staff, if they didn't then 80% of the staff wouldn't be able to get into work and it is written into their contracts. The buses even take people home if they feel ill etc during their shift.

If he has set shifts from x time to x time then he is quite well within his rights to stay until the end of his shift regardless of being told by his employer he can go home early. If he goes home early then i presume he either still gets paid for the rest of the shift or he takes it as holiday - either way the employer is paying for the time he isnt there working. If he wishes to stay until the end of his shift then he is entitled to.

yep that concept is quite popular in the food production industry and is a good idea tbh.

your manager says jump u say how high!

If he says go home u go home but you should still get paid for the time u should have worked
