Hey guys, I'm looking for a little help here so I don't make any rookie mistakes. I'm going to New York this summer for a few days and I'd love to get some shooting done, though unfortunately no girlfriend to come and be de facto model. In terms of model releases etc., can someone guide me through the basics of when I need them etc. and where I can shoot in terms of public/private land shooting law, including members of the public in the background etc.?

I guess if you are seeking actual subjects, whether paid or tfp, it will all be down to whatever agreement you have with the model. Though aren't they a bit stricter on records and age in the US?

Yeah that's what I'm asking basically in terms of what releases I need to get and possible permits on locations and restrictions on what's included in the backgrounds etc.

You don't need a model release to photograph anyone, the same as the UK. A model release is required for certain type of commercial photography such as royalty-free stock. That is you don't need a model release if you are not going to sell the photos. And actually the fact that you are in the US doesn't change anything as the rules are o ly on selling within the US and other countries. So if you take a photo of a model in the UK and try to sell it internationally as a royalty free stock photo you will need a model release. If you photograph an American in the US but only sell it in the UK then you also won't need a model release.

Furthermore, you only need a model release for certain types of commercial sale. If you are simply selling framed prints as fine art then no model release is required. If you sell the photos as editorial work then no release is required (that is why you see famous people printed in newspapers without giving any permission). Rights managed photography sales also don't require a release in most circumstances.

For property releases for the most part in the US if you are on public land then no property release is required. You get complex issues like the Eiffel Tower which in daytime no release is required but at night time a release is required because a company owns and operates the lights under copyright regulations( the ,iChat display is the companies IP).
