Smart/Variable speed motorway cameras

Just had a interesting read on another way to avoid speeding fines. Found it on getoutofdebtfree.org. Forum/debt collectors/page 62. Other way to avoiding speeding fines.
Basically a man was sent the form asking who the driver was at the time of the offence, he gave his own name but forgot to sign it. When it was going to court the clerk realised it had not been signed and informed the magistrate who then had to throw the case out.
Legally you have to give them the name of the driver but there is nothing to legally say you have to sign it.
The police have been surprised that no one has spotted this loophole sooner.
What do you guys think?

This loophole has been closed in England and Wales, although it still works in Scotland. You have to be very sure of what you're doing and ignore any visits from the police for 6 months after the offence. If you do it right, you won't actually have to go to court at all - they'll simply keep sending you documents which you send back unsigned until the offence times out.

Doubtless one day they'll do something about it and someone will be used as a guinea pig, but personally if I was caught speeding in Scotland, that would be the way I'd choose to deal with it.
