So, what can she expect.

Her boyfriend hit the roof when he found out. He just couldn't understand why she gave the police aggro and wouldn't take it on the chin. I believe her excuse was "I'm in a hurry and the limits are stupid anyway".

Oh well, guess she won't be driving for a while then. Serves her right IMO.

Seeing as she would have had to send her DL off anyway and produce them it makes little difference

She discovered that her Australian drivers licence had also expired and she hadn't bothered to apply for a UK one despite having lived here for 11 years.

Why had she only just discovered this in 11 years though  Surely her, or her boyfriend must have thought about that in the last decade or so? Or when she first arrived and started driving here?

That sounds very....what is that word I'm looking for?.....ah, yes - that sounds very 'Australian' :)

If thats her attitude with the cops, then she deserves to get the book thrown at her!

Could not having a full UK license have invalidated her insurance? I think it could have caused her some trouble if she'd had any scrapes.

To be honest arguing with the police she was asking for it.

Oh she's screwed :o

A very strange one though and hard to call, let us know when you find out please, be rather interesting. :)

Late for her shift at Walkabout per chance? Sorry :o

My past 3 insurers have all asked for a copy of my licence - in 11 years she has never been asked to provide her licence to an insurance company?

She sounds arrogant and irresponsible and deserves a heft punishment in my eyes.

Actualy I've never had to do that, and I don't know anyone who has.

Infact I don't think I have had to show anyone my driving licence since I obtained almost 5 years ago.

At the very least she is guilty of amazing naivety if not grotesque stupidity.

As she hasn't got a valid license she has no insurance as a result of misrepresenting her license status and she will have had to answer that question incorrectly each time she has taken out insurance (that bit where they state misrepresentation can/will invalidate the policy is exactly what this situation falls in). As a result of having no license, no insurance and no MOT she is quite seriously in the doo doo.

After 11 years she can't mitigate with lack of familiarity with UK legal requirments and the testimony of the two officers detailing her hostile reaction and reluctance to accept her initial penalty for an sp30 will more than likley result in significanltly more points/££ being applied than is normal in such cases.

I'd expect her not to be driveing for quite a while as each paragraph in itself is likley to result in a ban of some description and points being applied with a fine.

Oh and if she is banned and convicted of driving without a license/mot/insurance every insurance company will want a pound of flesh when/if she is able to insure another veichle.

I'd never normally ask this but as she's a 'special' case please tell me she isn't behind the wheel between now and the court date as apart from the legal ramifications that would be begging for additional police attention now they are aware of the situation but from her actions so far I've got to ask !

Beepcake i'm sorry to rain on your parade but certain underwriters will and do void peoples insurance for not having a valid MOT though usually this is only done in the event of an accident, the other half had the job of explaining this to a number of clients in her time working for a large insurance broker.

I've never known any insurance company void TP cover on insurance due to a failed MOT, and I'm not even sure it would be legal. Void the cover on the car that's failed, sure, but that's a million miles away from having no insurance.

as I was reading that... my face literally went more and more

Firstly, the 60 in the 30 might not be as bad as it sounds, not all 30 mph limits are ONLY available at 8:45am on a school day.

The MOT thing is a bit worrying, driving a vehicle not in a roadworthy condition...

but the real worry, is the licence, as she may as well be driving with no license

the lack of license and MOT I would assume would invalidate her insurance.

Id say if she gets some decent legal advice, she could hope for a hefty fine and a ban, mainly as I doubt she can get points on her auz license...

If judge gets angry she's looking at up to few grand fine. If judge is a numb numpt, and most of them are at that level, she'll get off with £60 plus court costs.

First reaction......silly woman, what was she on !!!

now, tell her not to represent herself in court with that attitude....get a solicitor to do the talking, she's not going to be on the road for quite a while.
