Sold a stamp

Hi all,

My brother has an ebay account and i have a paypal account. One of my brothers friends had quite a rare stamp that they wanted to sell. I said that i would let my brother use my paypal to transfer the funds.

The stamp sold for over £360 and was paid promptly by paypal.

On the auction, we stated that item would be sent via normal delivery unless insurance etc... is asked for BEFORE the listing finishes. 2 days after the listing finished, we sent the stamp. 3 days after the buyer requested insurance.

I now have a paypal claim against me giving me 3 options -

Refund
Provide tracking info
Give proof that a refund has already been made

We are not prepared to give a refund, and as we sent it standard del, how can we provide tracking info? The buyer mailed us after the listing finished (3 days after in fact) asking about insurance where we clearly stated that it should be done BEFORE.

Where do we stand now, as any money i recieve on paypal is on hold :(

You sent a £360 stamp, uninsured?

Okay.... Well, the onus is on the buyer I suppose as presumuably that opted not to take out insurance?

Still.. I woulnd't like to be in your shoes!
 
Legally its your responsibility to make sure it gets to him, you should have insisted on insured delivery on a high value item.
 
If you cant provide tracking info then paypal will automatically refund them, theres pretty much nothing you can do unfortunatly.

But sending something worth £360 uninsured is a bit foolish. Id have sent it RMSD at my own expense and if you knew the item was valuable you should really have made insurance compulsary on the listing.

They may have the stamp and be taking advantage of the fact that you sent it uninsured so they may well end up with stamp + money back

Id keep an eye on thier upcoming listings to see if they try and sell it on ;)
 
...surely it would have been more logical for him to file some kind of complaint if it never arrived.

If it gets there... there is no problem.

If not, then there is a problem at which point I can understand complaints being filed.


Some people's logic will never cease to amaze me :/

edit - unless of course they're trying to take you for a ride...
 
Buyers risk surely - His fault not paying the extra for insurance.

It might be a case of he received the stamp and said he hasn't received it...

Error! Why not simply make RMSD is the only option available on such an expensive item?

You should have at least got proof of postage. You have put the odds firmly against you now, especially since you used paypal.

Heh, made a mistake a few years ago like that with a 2Ghz PIV, asked my dad to post it off for me and he promptly bought a few stamps and threw it in the post box.. totally ticked me off. I just KNEW i'd get grief and the guy said he never recieved it, twas about 60 quid at the time so a bit of a loss. Kept watching his 'for sale' page, even made it my homepage :D, saw a PIV 2GHz for sale about 2 weeks later... nothing much i could do though.
 
If you haven't got proof of postage, the liability is entirely with you. Looks like you will be saying bye bye to £360 and the stamp.
 
For the sake of about a pound extra, your a fool and should deal with the consequences.
 
I'm afraid you will lose the money. There is really nothing you can do apart from make a claim through Royal Mail for your £32 compensation for a lost parcel.

Paypal will not help you in anyway what so ever. I even had proof of postage and signed delivery confirmation and the claim still went the buyers way.

Oh and you cant trust no one these days, not even a god damn geeky stamp collector. :rolleyes:
 
I've never sold anything on ebay, but just from reading these forums I know never to send anything of an amount I'd miss uninsured. If you knew the value of the stamp before listing, you should have put it as insured delivery only.

There's almost nothing you can do now. You have no proof of posting or tracking, and paypal always side with the buyer. It's most likely the item has been recieved and the buyer has got himself a nice freebie.

I would most certainly have gone to the police to be honest, hes selling stolen goods :)

Plus id have bid it up to a silly amount just to make sure he got hit with hefty ebay fees

And i may well have paid a visit to his home and relieved him of my property

Surely you could take the buyer to a small claims court now.
 
whenever i sell something on the intenet i make sure that i use a postage method that will cover the full value of the item just incase it goes missing if i have to claim.

i can't believe yout sent an item of that kind of value by normal post :eek:
