Solicitor complaint.

The whole 'legal aid' thing was a way to extract tax payers money and into solicitors pockets - it was as crooked as it gets, but it looked good for the masses to get free legal assistance in their hour of need - unless ofcourse you were an hard working tax payer because you can't claim it - it was only any good for the scum bags that lived off crime in the main.

I work in Clinical Negligence and when Legal Aid stopped I was told that we would get a lot less claims coming in.
At that time we were on about 125 a year but this last year it has gone up to about 325 because Legal Aid has been superseded by a Conditional Fee Agreement and it's obviously better for the Claimant.

Were they not considering stopping such things against the NHS also?

I'm not really sure how it works, I had one of my Solicitors/Managers explain it to me then lost interest :D
I think it's a type of insurance so the Claimant doesn't have to pay a penny.
The Claimants Solicitor must apply for it and then we get a letter saying they have one for their Client.

I can't see how it can be stopped, if negligence has happened then patients deserve a payout. I'm not a Radiologist but even Stevie Wonder can see stuff on some Images that the Clinicians missed (or didn't look at more like).

It's hard to say.
We always said that out of 10 Pre Action Disclosures only 1 would go to a Letter Of Claim which is when the Trust Solicitors and NHSLA get involved. That means that 9 out of 10 Solicitors read the disclosure and realise there isn't a case they could win.
I'm not sure of the % of Letter Of Claims that win but when it's got to that point the Solicitors Experts are quite confident of a win so it's down to damage limitation and how much they will take.
I do know we win quite a few when we actually go to court.
