Evening all,

Just looking at any advice for my brother and I who are beneficiaries in our Dad's Will.

So I've notified the solicitor (over the phone) who is named executor and they've acknowledged that they have the Will, which was setup in 1990. Recemption team asked for death cert and covering letter of the will. I sent this the same day via email on Monday 25th Nov, I also requested that they renounce their executorship owing to the simplicity of the estate. I have had no response since. I have called them and they are looking into it. I have nothing in writing so far.

Any advice to help this along or options open to me in this scenario?

Cheers

Harass and harangue them daily, it will be on the to do list of some junior dogs body and they will only prioritise it if you make yourself an annoyance they want rid of.

100% this. Solicitors are generally lazy gits and will only do something if you hassle them daily. I literally mean daily

Or a lot of them are very busy and working down a lit of priorities?

i know a couple who will be answering "urgent" calls to do with house/property sales that could have been done weeks earlier if their clients had responded to a query, or could have been left another couple of days but the client wanted an answer at a time they knew the solicitors were off...

Having said that over 2 weeks and no response at all is terrible, I know when I've had a query for a solicitor I've normally had a reply from at least a secretary or receptionist within a working day to say "we've received your question and will be back to you by X" as the minimum.

That's a legal matter. I imagine you could google the pros and cons to do with this? My own dealings involved the solicitor taking far in excess of the time he'd agreed to finalise. So much so that I had to remind him. Good luck.

Probate solicitors tend to take forever to do these things, also doesn't help if they specialise in other areas. My mother and her siblings had to go through this a couple of years ago and picked a solicitor who was recommended and well rated. Turns out he only does a little bit of probate work and mainly deals with criminal law. That meant very little time was actually spent doing any of the probate work and it dragged it on and on.

This is a simple task I believe. The law society actually advises solicitors to do this if the estate is straightforward and no disputes with beneficiaries etc

Don't expect a quick response from the Solicitor. In general, they are not fast moving people, but especially so just before Christmas when they'll be trying to wrap stuff up for their paying clients before the end of the year. I wouldn't expect to get a response before January. You might be able to speed that up by hassling them, or you might just annoy them and make them even slower.

As other have said turn up in person and generally make a nuisance of yourself. People who make a lot of noise get priority if only to shut them up and make them go away its a sad fact of life.

As above don't expect this to happen swiftly.

My Aunt died 23 months ago and it's still not sorted, mainly due to the solicitors being incompetent.

My Dad passed away last week and I am hoping this one is less hassle as I don't think I have the energy or patience for another long-drawn-out legal process.
This, its astonishing just how incompetent they can be go to a solicitor to sort out something simple like conveyancing and they still manage to mess it up completely, farming it out to non-qualified conveyancing agents was maybe not a good idea, I mean firm of solicitors you'd expect at least competent service and not a dogs dinner
