Last week I sold an ebay netbook , Acer one for under under £130, the buyer got this for a good price, open receiving my item immediatly emailed me stating me he wants to return it. for 2 points

The rubber feet on the bottom had come off, to be fair i did not notice this, but the person who had supplied it had upgraded the memory. You have to remove them, - So little I can do about this.

He is upset that I have put an unregistered o/s on the machine. I stated in the auction is for 'trail' usage, as I did not have a external cd drive to install the original o/s. Although i did not put this in my description it was asked in the Q and A section at the bottom, I did clearly state this.

The netbook is in a used condition so you have to consider some wear and tear happens.

I think it is alittle harse that he should be sending it back, i have replied to him and offered him a small part refund to purchase the feet.

If he does not accept this offer where do I stand? It was stated in the auction about the operating system so is he able to return it even though it is working?

What gets me is that he receieved it at 10.30am, and his email was at 10.42am. 12 minutes later, I get the impression this was an implusive buy and he doesnt really need it, and it feels like a petty excuse to waste my time.

I sent him the reply to this email saturday dinner time, he has not yet replied back to me. It is annoying as I do not know if the money is mine from the sale. Maybe he wont get back to me now? who knows.

Additionally in this circumstance does he have to pay the postage back? I have stated if he wants a refund I will only refund the original trasaction.

If he goes and buys an OS, then it will cost him another £50 at least for a real copy, that's a fair whack of the price he's already paid - especially if the description did not mention that it was a trail(sic) version of the OS.

Did you state the product EXACTLY as it is? What exactly did you write about the OS and what is the actual situation with it?

Not nessescarly no, my father in law purchased a legit xp coa for £25 a month ago. This is what I offered the buyer in compensation for this problem.

BTW it had a had non legit version of 7 ultimate on it. Which is fully working. Hence the reason I stated it was a trial, I should have maybe worded this better I admit.

there are free OS's...

the machine probably has a coa for windows attached anyway?

personally I would ahve emailed him after the auction to confirm he was ok with the lack of of, he SHOULD read the auction properly but not everyone does...

get the machine back and refund him is what I would do... his mistake so he can pay for the return (in my view)

Agreed this is probably what I`ll do.

too many people buy these netbooks on impulse i did myself, was for purchased for my missus but she didn't like the screen size.

Whats annoying is that the money from the sale is now tied up, so if he returns it I have to resell, cannot afford it to go for less than £100.

As for a COA sticker no theres not one on there. which is why Ive offered him part refund to buy one.

I'd be quite annoyed to have feet on the bottom of a laptop. This could scratch/mark the surface I was using it on. You should have mentioned this in the listing, the fact someone else upgraded the memory is irrelevant.

You didnt even mention in the listing that it wasnt a full version of Windows 7?
I would be returning it to you as well, at your cost. (Or a refund for the price of Windows 7 Ultimate - not 25 quid for an old version of xp)

I reckon if this became a dispute then it would go the way of the buyer. I also think it's a bit silly that you tied up the funds so soon after the auction ended.

It's really up to you what you do, it all depends on how much hassle you're prepared to take.

Buyer has every right to expect a refund IMO, unless you explicitly said it had no licensed OS installed.

Item number ... ?

Not sure if i'm allowed to link to ebay, but here is the wording from the listing:

Acer One Netbook.

This model features the bigger 160 GB Hard drive, and has also had 1 Gb of extra memory installed, brining it to a total of 1.5GB.

Currently has Windows 7 installed.

The condition of the laptop is very good. The no major scratches, 1 very tiny hairline blemish. This is being very crititcal, unless you hold it up to bright light it looks brand new. The Screen has no bad pixels and as very bright.

Payment and postage

Payment to be made via paypal. Item can be collected, I am located five minutes away from the M1 junction 26, or can be sent out on special delivery.

I was talking about replacing it with a starter version of win 7.

I realise there are free operating systems; but if a machine is sold with a copy of windows 7 which should just work, why would a regular user want to switch to a free os... heck. they probably wouldnt even know how!
