To cut a long story short, I bought a TV from this shop and they delivered it, and then I wanted a different tv so they said, 'no probs, we'll pick up the old one when we drop off the new'

Great I thought, so they come today and drop off my new telly, I sign, they guy notices the telly in the hall waiting for him and says '2 tv's eh?' and walks away.

Now I have 2 TV's.

What do I do?

1) Leave it, wait till they contact me and charge them £5 a day storage (which I have been told I am perfectly within my rights to do  )

2) Ring them.

3) Send them a letter along the lines of, 'TV not picked up, you have 1 month then I will leave it on the street, if it gets knicked it gets knicked. (not my idea)

or other?

Its more than likely they will come and get it sooner or later, wait a week and ring them? Well thats the right thing to do :P

Same thing happened to the gf, she ordered a 28inch widescreen tv off amazon for like £250. The one they sent had been damaged pretty badly in transit, so she didnt sign for it and it got returned to amazon. She phoned up to complain on that same day. They sent her out a replacement and then a few weeks later another £450 jvc arrived aswell!

gotta love it when they make those kinda mistakes :)

I made her keep them both, stick it to the man.
Although if its a small retailer I may have thought twice about it.

I think they have 6months in which to pick up any goods, if after that time they have not attempted to pick them up the goods belong to you.

(Not a clue if it's true, just something I always remember being told once!)

Usually they do a seperate deliver/pickup, just wait for them to pick it up. If they havn't within a week, phone them up. Not hard to figure out really is it. I've had it happen loads with all the different TVs we've had.

look to see what should have been delivered, if you signed for 2tv's they will get one back but if you only signed for 1 and got 2 keep them and say you never received 2 of them and they cant say you did

Not true.

You will be responsible for safely storing it till they collect it, if ever. Until a judge makes a ruling on just what is reasonble in these cases anyway.

Also you can only charge a rate similar to a commercial storage company would charge so no £1000/day fees.

IANAL

Send them a recorded delivery letter asking them to collect it, stating that after 1 month you will charge storage at £???? a month and if they haven't collected it after 1 year you will dispose of it and sent them the balance of sale less storage fee, which would work out the same...............

Kinda, I signed, grabbed my tv to move it out the way to get the other tv out and he was gone.

And he left the door open.

well you should have said asked him... but then if he was supposed to take your other TV it would be in his notes

Like Freeman said, the item to be returned is very rarely picked up by the same van which delivers the replacement. Contact the seller and ask when they intend picking up the other one so you know whether to put it out of the way or keep it handy.

We had a problem like this a few years ago at Christmas.....

I wanted a mini disk player so my parents ordered me one from an online retailer, instead we got a Sony DVD player through.

So we sent the complay an e-mail telling them. When they e-mailed back they told us that they would send someone out to replace the DVD player for a mini disk player. When the courier came he gave us the MD player and went, So we sent the company another e-mail telling them what had happened so they said they would, again, send someone out to collect the DVD player.

Instead they delivered another MD player and left, again.

After that we sent them yet another e-mail saying that if they didn't collect the things within 6 months then we'd keep them.

We never got a reply so we kept the things.

Pretty bumper Christmas that was. ;)

I say just e-mail the company again and say that they have 6 months to collect it or you're keeping it. :)
