I had an appointment last week and was told to get new glasses.

There was a special deal, £125 frames were available to me for £40 - student discount, it sounded good at the time so I decided to take it. That was last week, this week they are ready, however I've changed my mind as I wear contact lenses and rarely wear frames. Am I entitled for a refund (I paid last week) and for the frames to be returned? The guy over the phone told me it might not be possible for me to get a refund.

Any ideas?

It has been standard practice at every opticians to accept returns within thirty days. This is purely because satisfaction is very difficult to prove regarding visual correction of the lenses. It is also on the t and cs of Vision Express receipts. Boots Opticians operated in this way and so do D and A.

If I recall correctly, I didn't sign any forms, I confirmed the purchase by paying the fee of £40.

Although it was a week ago and I honestly cant remember that clearly, but if I did sign a slip, then yep I'll admit defeat. However if I didn't sign a contractual agreement, am I entitled for a refund then?

A contract does not have to be in writing to be valid in England and Wales, an oral contract is just as valid. By paying the £40 you have implied a contract and agreed to their T&C on the contract. So depending on the T&C, you'll find out if you can get a refund or not. But changing your mind is not a reason in law to get a refund for an item, actually, you have no grounds for a straight refund in law anyway, only in replacement and repair.

Just go in and tell them that you aren't happy and they should refund you.

A word of warning however. As a contact lens wearer, you are an idiot if you don't have glasses as a backup. Your eyes need regular breaks from the lenses and glasses in the evenings are ideal for ensuring that by the time you are 35 you can still wear lenses without an issue.
