Hi, all.

Just after a bit of advice on where I stand. I was pulled over for doing 34 in a 30 on the 6th of July. I have today finally recieved the letter. The letter says:

On 06/07/2012 at 17:37hrs at CHALK LANE, NARBOROUGH you were driving vehicle registration xxxxxxx.

Obviously commiting an offence. I explained to the officer that I am going away on operations and will not be back in the office until November (I have come back early). He offered me the speed awareness course and would put on my notes about my work till Nov. I went on my merry way. The letter, dated september says that I have 3 penalty points and a £60 fine to be paid within 28 days.

Here are my issues.
1. The date the letter was sent was 06/09/2012 2 month after the offence.
2. They have put my name down as David not Daniel
3. My address is incorrect
4. I have only just recieved the letter.

Does anybody have any experience of how I can sort this out? Thanks in advance. Dan Dan

THERE IS NO THRESHOLD. The limit is the limit.

What do you want advice on? Pay your fine accept your points and be on your way.

I thought the threashold was 6-7mph over the limit? not 4mph?

Some forces will give you the grace of 10%+1mph on lower speed limits (30/40) meaning that in a 30 you'd 'get away' with 33mph. 34 being the cut-off point. (45 in a 40)

However like others have said it's not an absolute.

As for the fine, since you were pulled over the standard 14 days for the NIP doesn't apply. You were informed by the officer at the roadside and presumeably you signed a piece of paper to state this. IIRC They have 6 months from then to prosecute.

It may be possible to have the ticket quashed though because of the incorrect details but I would suggest getting proper legal advice on that if you wish to try.

Getting done for 34 in a 30? That's really harsh. But by my understanding, if the date written on the ticket is more than 2 weeks after the alleged offence, then it's invalid.

34 in a 30 might seem harsh but his speedo was probably reading a tad under 40 so he knew he was speeding.

But it isnt my name on the letter and when pulled over i was never issued with a ticket? Just told that I will recieve a letter in november saying that i have to go to a speed awareness course.

Extremely harsh?
Limit is 30 he was doing over nothing harsh about it.

as for the details I'd get ni touch with the police force that puleld you tbh

There must be, as if I am going 31-32mph, or even 33mph I have never got a ticket for it? unless the camera was broke, but highly unlikely.

I think most of you have missed the point, His Name & Address on the letter were incorrect although how he came about this letter I'm not so sure of.
