Well someone has an illegal listing currently up.

Not sure if i'm allowed to post actualy links to this in particular, but basically it's online cheat software for poker, for use in partypoker.com. He claims it's legal but as set out in the T&C on party poker (part 7) Here , the software is against T&C. I tried to report this to ebay, but there doesnt appear to be the correct category to report this in particular. So does anyone know how i can get hold of ebay directly or suggest what i ought to do?

(If i get confirmation from a don i will post the link to the item itself)

Because it is against party poker's T&C doesn't necessarily mean it is against ebay's rules. It might be but not necessarily.

In a civil court but it isn't illegal per se.

If you feel strongly about it then why not email the URL of the auction to Party Poker and let them be the ones to contact ebay if they wish :)

ebay doesn't care much tbh.
ebay's t&c state that u cant sell non authentic goods.
look at the number of counterfeit items that are listed.
as long as they get paid. :o

its not agains the law though, you can sell it, you can but it. You can even use it on the partypoker site and it will still be legal. It only goes against PartyPoker T&C, allthey can do is ban you account and try suing you, but they probably wouldn't even do that.

Ebay wont remove it, even if partypoker gets in on the act.

But where's the contract? Has the person who created it breached a contract? How do you know he has a contract with Partypoker?

what would be illegal about buying or selling it? you could buy it and never use it, have you done anything wrong or broke any rules or contract? no

I play online poker using partypoker all the time. I would be gob-smacked if there was any genuine software that lets you see your opponent’s hands. This stuff is a con 99.99% of the time. All this software probably does (if anything) is give you stats on your opponents using the hand histories. That's not cheating and will be useless to you unless you’re a semi-pro level player.

Obtaining money by deception is illegal though... if that's what the software allows then....
