Terminating a tenancy agreement

Evening all,

I'm after a little advice regarding a property that i'm renting out privately.

My tenants are messing me about with not paying the rent via standing order ontime. We had a written agreemtent that the rent will be paid into my account on the 23rd of every month. Now, they have never paid ontime, usually saying that they don't get paid till the 27th etc etc. The reasons go on and on. They haven't paid me for this month yet and I recieved a text from them telling me that I can collect the rent today after 9pm. I think this isn't fair as 9pm is too late and they are basically having a laugh.

Now my question is that can I give them notice to terminate the tenancy agreement early? Seems as they have already broken the agreement themselves?

Tbh I don't think paying the rent a week late is sensible grounds for eviction.
 
Sounds like you are looking for reasons to kick them out.

A lot of people don't get paid until the end/start of the month... most I know get paid around the 25th or on the 31st/1st
 
The 23rd of every month was what they wanted. I'm going over there at 9 to collect the rent and have a word with them. If things don't improve then i'll seek legal advice.

talk with them first, maybe change the date of paying and warn them, if it continues and they cannot meet the new date, evict.
 
Maybe you should have researched your rights as a landlord before you actually went ahead with it?

Basically though, you're stuffed, at least in the short term. You can't force them out without going through the courts which can take months.

You can evict them, but if you want to avoid court etc. etc. then stick to the time agreed in the contract.

I trust you did set an agreed time that they have to get out if you want them out? We're in a rented house and our landlord has to give a 2 month notice.
 
Surely they agreed to the date before taking the property, and if there was a problem then, they should have let you know? It shouldn't matter when they get paid though, they need the money every month regardless. Are people really so useless that if their rent doesn't go out just after they get paid then they'll spend the money?
 
Just to be on the safe side why dont you change the date the rent is due to something like the 2nd of the month so theres a few days leeway in case there paydate changes, especially if they are paid 4 weekly rather than monthly
 
Install webcams around the house and we'll vote which person should be evicted on a weekly basis.

Could be fun!
 
Changing the date my be your best bet

I would be making them come to me with the money think its wrong you running about the place1

Never missed a payment when I was renting but I very much doubt my landlord would be happy to run about after me

Hope you get things sorted out :)
