Although to clarify, I mean stationary at traffic lights, in jams etc. Although even parked up there are risks.
It's about being aware of your surroundings. Something you're not doing if your head is in a phone.

They have careless driving / due care and attention laws in every state - anything else is just an infringement of civil liberties for the sake of lazy target driven policing and / or headlines for equally lazy politicians.

I was amazed when I saw a guy shaving (with an electric shaver before you ask) whilst driving and anther reading his giant map book.
The most outrageous behaviour I've seen, though, was when I was behind a guy on the motorway and saw him holding his coffee in one hand whilst talking on the phone with the other. It took a moment to realise that the car was left hand drive.

It is legal, but some police officers may treat it the same as eating or drinking if you're not paying attention.

I never do it and never answer my phone either when driving. In fact phone goes on silent. I think people caught speaking on their cells or texting should have their licenses yanked and driving ban for 5yrs. If they kill someone they should get life but of course in our dear old country that never happens.
People will read this probably think "harsh"...until one day your girlfriend/boyfriend or someone you care deeply about is smashed on the road cuz some asswipe was texting his mate while driving.
Turn that dang phone off unless its an emergency I say
