US: The Pitt

Decided to give this a go after reading the comments in here. Three episodes in so far and I’m not feeling it. Noah Wyle is good as always, apart from that pretty average so far. I’ll probably get through the season to see if it picks up.
Really? Me and my wife watched season 1 a few weeks ago and thought it was a 9/10 show.

We gave it a break for a few weeks but will start watching season 2 soon.

I just couldn’t get into season 1 and it only got interesting near the end with the major incident if I remember correctly.

I did say the below after my original post and I’ll certainly be watching season 3.

Actually enjoyed season 2 of this after giving it a break after season 1.

FFS, this better not get it cancelled

US drama The Pitt is similar enough to medical series ER for a lawsuit against its producers to progress, a court in the US has ruled.

The widow of Michael Crichton, who created ER, argues The Pitt is effectively a reboot of the series, which has been made without proper permission or credit.

it’s probably not going to succeed and the only people who would win are the lawyers.

It doesn’t use and IP from ER so I can’t see how a claim would be successful. I can’t see how anyone could own the copyright of a ‘faced paced medical drama set in an emergency department’. After that the similarities largely end.

It would be like the BBC during channel 5 over 5th gear or amazon for the Grand Tour.

It originally was though which is where it gets complicated. They were negotiating rights to make it a spin off but that fell through so it was moved to a different city and Noah Wyles character renamed. BBC article doesnt mention that showrunner R. Scott Gemmill, and executive producer John Wells along with Noah Wyle where part of the team negotiating for the rights.

It will likely be cheaper to settle than go to court

See my top gear and grand tour example.

Clarkson left the BBC and essentially made a carbon copy of the show but it was legally distinct for copyright purposes but otherwise was conceptually the same show.

The things they changed were as simple as the grand tour was in a tent where as top gear was in a studio. A few small changes like that is all that was needed for it to be ok.

The same thing applies here. All you have to do is change a few of specifics and it’s legally distinct. They would have lawyered the snot out of this before they green lit the production.

The person who owns the rights to ER does not have the right to veto someone making a similar show. They changed quite a lot about the show which makes it legally distinct and is a long established principle in TV and Film.

It’s utterly irrelevant that they originally set out to make a sequel/spin off to ER because they ultimately didn’t.

The likely motivation here is money and they are aggrieved they have been cut out but ultimately that’s fine.
