I don't think Overclocking will voided any warranty.
Have you tried taking card out and re-seating it? Change of power cables? I have had some strange things happen with damaged cables.

Sounds like a software issue, get rid of the EVGA precision software.
Ive had problems like this caused by GPU overclocking software (must say not the worse performance just the clocks doing strange things in 2D)
Those are good temps. Mine is 33c to 35c on idle. on load it can hit 73c
Yeah that's what Kelt is getting, mine is posted further up. 54C at idle, with the card stuck on boost.
I've emailed Gigabyte returns anyway
I had mine stuck on boost the first few days after getting it. I think I hit something on precision X, all I did was uninstall it and it went back to normal. 54c is very high for idle.

Also, should I be contacting the retailer also? Or just go straight to gigabyte and see what they say?
Are you able to try the card in another machine, a friend's perhaps?
****ing mental. Looks like destructive reinstall is not enough to reinstall windows fully. Turns out I have a virus called cmg.exe which is maxing out my GPU usage, and obviously starving it of power during games.
Killed it, loaded up BF3 and constant 60FPS, as opposed to 20. Boost turns off correctly once back to desktop. Man I would never have guessed it to be a virus causing this in a million years.

I use eset nod32. It's never failed me yet
