Strictly speaking, yes.
so is enforced? or are O2 just slow to update there T&C's in accordance these new hyper cool phones

Strictly speaking, yes.
I doubt it's strictly enforced, more likely to be used as a specific clause to deal with someone abusing bandwidth.
In reality O2's limit is 1gb per month , I got warned for exceeding this one month on my mobile when home internet was down. Thats on a 12 month simplicity contract with the "unlimited" internet bolt on .
I just ordered a Desire on 3 last week and will have it on Sunday (I'm currently abroad) and I'm pretty sure the contract was £35pm for unlimited internet, texts, 750mins, and free Spotify for 24 months. I now notice the contract is slightly different - £33pm with 900mins. It's also now saying the "unlimited" internet has a fair use policy of 500MB and you'll be charged at standard rates if you go above this! How can they advertise this as unlimited internet??
I'm certain it didn't say this when I took out the contract last week. It'll be interesting to see what exactly it says on the contract once I get a look at it.
