Torrent client

I've just found a couple of links that say it was eMule and uTorrent type clients that DL targeted, i knew i'd read it somewhere that eMule type clients where involved, i guess we where both right, and wrong, LOL.

legal action for downloading Dream Pinball (Davenport-Lyons)

Just got a letter from Davenport Lyons RE-Colin Mcrae Dir

I got my information from news articles, some specifically state that file sharers have been chased for using bittorrent. This particular one says: -

"TopWare had previously won four rulings against sharers of the game, but none of those cases was contested, making this most recent case the firm's first contested victory in the UK over file-sharing.

The four other file-sharers were ordered to pay £750 each and costs of £2,000. The cases involved the BitTorrent system of file-sharing, which automatically shares files once a user has downloaded them in order to make the system an efficient distribution mechanism."

I know it's probably not a superb source, just the first Google spat out. I've seen many.

Needless to say though that if you're still using torrents you're just asking for it, they're completely unsecure.

It's a good job i don't download ilegal content, all i use uTorrent for is to download Nokia mobile phone firmware from a company called JAF (Just Another Flasher), it's the only way to get good and also the latest Nokia mobile phone firmware files, and i must agree, eMule type clients, and torrent type clients are pretty unsecure.

I did some rooting around and found the original article. :D

http://www.theregister.co.uk/2008/07/02/davenport_lyons_dream_pinball_win/

"The Central London County Court has ordered four BitTorrent users to pay a video games company £750 interim damages following a landmark victory by no win, no fee copyright lawyers.
The final damages could run to £2,000, plus costs of up to £1,500, the Evening Standard reports."

"Davenport Lyons has pioneered a new market in tracking filesharers online and then contacting rights holders to suggest they sue."

"The witchfinding BitTorrent-tracking programme is outsourced to Swiss firm Logistep, which promises its findings are "fully accurate"

So, basically, these Swiss people are probably downloading torrents for games by Codemasters or Topware, or whoever, connecting to the swarm, and logging all of the IP addresses. Davenport Lyons takes that information and gives Codemasters a call saying "we have solid evidence of people downloading your games and will sue them if you want".

LH-ABC version 3.2.0 here, can't beat it :D

(latest 3.3.0.1 makes it look a lot more bloaty)

Actually that looks like similar to uTorrent, it doesnt everything i need, if it has a better webUI and scheduler, i'll ditch TorrentFlux & BitTorando since i can't be hassled with needing a web server just for my TorrentFlux Web GUI.

Just reading through this thread, if torrents are deemed to be trackable in the sense that people are now getting sued for their activities, then surely it's just as easy using the newsgroup software listed above?

No, because usenet/newsgroups aren't peer to peer. Plus they're more of a "dark art" less minstream people use them, so smaller target market, less money spent trying to catch people. Its possible but for now they leave us alone :)

As LeperousDust already mentioned...

Usenet is not peer-to-peer, so if Davenport Lyons wanted logs from a usenet provider they'd need some other way of getting their court order. As it stands most usenet providers offer a 256-bit SSL encrypted connection, so I would be mighty impressed if they managed to get any evidence whatsoever.

Even if Davenport Lyons did get a court order, by some miraculous divine intervention or something, I've heard some usenet providers only keep logs for 24 hours anyway. I'm not sure if mine do this but it'd be great.
