TREE WITH TPO GETTING IN THE WAY OF PLANNING AN EXTENSION

No reason not to apply for the tree to be trimmed back, even with a tpo there's no reason to deny this as long a no harm comes to the tree.

I can only suspect that the tree while in the neighbours property is relately close to the boundary so it'll be more the root protection distances encroaching into the OP's fathers ground that will be the issue. Any extension within this zone may chop the roots significantly enough to kill it in the future?
 
Have 2 tpo oaks in the garden.
No way you'll get them gone legally.

Don't do it illegally. The neighbours house was bought with them knowing about the tpo.

And you can get them cut. But you'll need an arborist and ideally a company who has worked with the TPO officers before
 
Its in your neighbours garden so you won't be building over it directly

As other have said get it trimmed (will require planning for this)

Different species of tress have different roots - research this and incorporate root friendly foundation solutions into your plans
