Use of a phone whilst driving

So, unsure where to put this (GD/Football forum or here) so chose here, as some may know there was a video recently filmed of Ex-Liverpool FC player Jamie Carragher receiving some banter after the Manchester United game which led to Jamie spitting at the driver, now the driver at the time was filming this on his mobile phone....

Now the police have subsequently spoken with the driver (confirmed by an interview in the Mirror) (https://www.mirror.co.uk/sport/football/news/man-who-filmed-jamie-carragher-12182929) and he says they understand the traffic was bumper to bumper and will face no further action.

So, this is my problem, the video clearly shows it's not bumper to bumper traffic at all and he's driving, so has this just made a complete mockery of the severeness of the message of not to use your phone whilst driving?

What are the thoughts on this? Should he get off scot-free? Should the video be evidence for prosecution?
 
I think he should be deported to Australia. Seriously though he should be penalized to the letter of the law. He was being a bell anyway.
 
yup he should be hit with the same penalty had the police simply caught him using his mobile phone.

edit: and just to be clear, Jamie carragher is a tramp.
 
Using a phone whilst in control of a vehicle is an offence...whether you're moving or not.

One rule of one, one for another...
 
I'm a Carragher fan. Not just football but he's a decent generous lad too. However he should be prosecuted for spitting.. He shouldn't lose his job though and the the other driver should also be prosecuted.
 
Both of them should be prosecuted. Of course there are also the repercussions on Carragher's career as well....personally I believe people in the public eye, on salaries that we can only dream of, be held to a higher standard.

But what makes this guy so special as to not get prosecuted?

This is a high profile thing at the minute and is sending out totally the wrong message.
 
Whilst on the subject of using phones whilst driving. I don't think the penalities are hard enough. I still notice plenty of people using them on main roads and motoways.

I think those who commit this offence should receive a ban.

Penalty is already quite strict, it's just there isn't enough presence on the roads to enforce it. Sure, you could take a picture of someone doing it, but the ironing..

What's the point if there are no police free to enforce it? The issue isn't the penalty, it's all down to enforcement.
 
I still think it’s amazing there’s no difference in punishment between someone driving along looking down at their phone, and someone driving with their phone to their ear, looking at the road. The former is clearly considerably more dangerous than the latter but they’re treated in exactly the same way.
 
There has generally been a reluctance to prosecute over offences like this when it is in online video, etc. there have been a few cases where they will only use it along with other evidence like some of the people uploading footage of themselves doing considerable speeds well in excess of the limits, etc.
