anyone explain this, sure the graphic card is broke, does this on about 2 other games, using current driver

Hard to tell from just that, but looks pretty borked to me. Dell''s do have a tendancy to get a bit toastie inside the case. Have you had a look at GPU temps etc when this happens?
 
On the basis that you'll likely invalidate any Dell warranty if you start to prod around I'd get it back to them ASAP. I'm assuming from your clocks you've overclocked the GTX. Remember to return them to stock or your warranty will be questionable.

Dell cases are *Oi no swearing!* for cooling on the whole so if you have OC'd the card, my money would be on bad temps. Have you checked them? Have you re-run the card at stock clocks?

While your're at it, you might want to get them to rip out the Ageia and the X-Fi!
